Update: Pentagon Abiding by DADT Injunction

An official Department of Defense news release indicated the Pentagon has “halted discharges” under the US law declared unConstitutional.

According to Politico, a Sailor discharged under DADT was rebuffed when he tried to re-enlist, causing a lawyer for the Plaintiffs to say the government might be in contempt of the court’s ruling.

The LA Times reports that “legal scholars” are questioning the authority of a district court judge to enjoin the entire military, when the Plaintiffs were not granted class-action status.

The Justice Department has requested a stay of the injunction saying it would “irreparably harm the public interest in a strong and effective military.”  Another reason for the appeal is the appellate process isn’t complete and could place homosexuals in the military in an odd position if the ruling is ultimately overturned.  The American Legion called on the Obama administration to appeal the ruling.
