{"id":7650,"date":"2010-10-15T00:20:14","date_gmt":"2010-10-15T06:20:14","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=7650"},"modified":"2013-10-04T21:11:06","modified_gmt":"2013-10-05T00:11:06","slug":"update-pentagon-abiding-by-dadt-injunction","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2010\/10\/15\/update-pentagon-abiding-by-dadt-injunction\/","title":{"rendered":"Update: Pentagon Abiding by DADT Injunction"},"content":{"rendered":"<p>An official <a href=\"http:\/\/www.defense.gov\/\/news\/newsarticle.aspx?id=61279\">Department of Defense news release<\/a> indicated the Pentagon has &#8220;halted discharges&#8221; under the US law declared unConstitutional.<\/p>\n<p>According to Politico, a Sailor discharged under DADT was <a href=\"http:\/\/www.politico.com\/blogs\/joshgerstein\/1010\/Pentagon_accused_of_ignoring_dont_ask_ruling.html?showall\">rebuffed when he tried to re-enlist<\/a>, causing a lawyer for the Plaintiffs to say the government might be in contempt of the court&#8217;s ruling.<\/p>\n<p>The <em>LA Times<\/em> reports that &#8220;legal scholars&#8221; are <!--more--><a href=\"http:\/\/www.latimes.com\/news\/nationworld\/nation\/la-na-dont-ask-20101014,0,2232874.story\">questioning the authority of a district court judge<\/a> to enjoin the entire military, when the Plaintiffs were not granted class-action status.<\/p>\n<p>The Justice Department has <a href=\"http:\/\/www.msnbc.msn.com\/id\/39672353\/ns\/us_news-life\/\">requested a stay of the injunction<\/a>\u00a0saying it would &#8220;irreparably harm the public interest in a strong and effective military.&#8221;\u00a0 Another\u00a0reason for the appeal is the appellate process isn&#8217;t complete and could place homosexuals in the military in an odd position <a href=\"http:\/\/www.airforcetimes.com\/news\/2010\/10\/military-moratorium-on-enforcement-of-dont-ask-dont-tell-101410w\/\">if the ruling is ultimately overturned<\/a>.\u00a0 The <a href=\"http:\/\/www.legion.org\/security\/91953\/foster-calls-suspension-dadt-ruling\">American Legion called on the Obama administration<\/a> to appeal the ruling.<\/p>\n<p>The case was previously <a href=\"http:\/\/christianfighterpilot.com\/blog\/2010\/10\/14\/secdef-opposes-court-injunction-of-dadt\/\">noted here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An official Department of Defense news release indicated the Pentagon has &#8220;halted discharges&#8221; under the US law declared unConstitutional.
