{"id":5622,"date":"2010-06-01T00:30:34","date_gmt":"2010-06-01T08:30:34","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=5622"},"modified":"2011-03-23T23:21:49","modified_gmt":"2011-03-24T04:21:49","slug":"memorial-day-2010-celebrated-without-protest","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2010\/06\/01\/memorial-day-2010-celebrated-without-protest\/","title":{"rendered":"Memorial Day 2010 Celebrated Without Protest"},"content":{"rendered":"<p>It may come as a surprise to some that Memorial Day, as <a href=\"http:\/\/christianfighterpilot.com\/blog\/2010\/05\/04\/president-proclaims-national-day-of-prayer-6-may-2010\/\">proclaimed by\u00a0the President<\/a>,\u00a0is unConstitutional &#8212; at least by some people&#8217;s\u00a0logic.<\/p>\n<p>Like the National Day of Prayer, it is annually recognized by a statute initially passed in 1950 (1952 for the NDoP) that calls on the Nation to pray:\u00a0 <!--more--><\/p>\n<blockquote><p>Sec. 116. Memorial Day<\/p>\n<p>\u00a0\u00a0\u00a0 (a) Designation.&#8211;The last Monday in May is Memorial Day.<br \/>\n\u00a0\u00a0\u00a0 (b) Proclamation.&#8211;The President is requested to issue each year a proclamation&#8211;<br \/>\n\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (1) calling on the people of the United States to <strong>observe Memorial Day by praying<\/strong>, according to their individual religious faith, for permanent peace;<br \/>\n\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (2) designating a period of time on Memorial Day <strong>during which the people may unite in prayer<\/strong> for a permanent peace;<br \/>\n\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (3) <strong>calling on the people<\/strong> of the United States <strong>to unite in prayer<\/strong> at that time; and<br \/>\n\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (4) <strong>calling on the media to join in<\/strong> observing Memorial Day and the <strong>period of prayer<\/strong>.<\/p><\/blockquote>\n<p>The statute, as quoted above, uses similar &#8220;religious&#8221; language\u00a0to that establishing the NDoP, which <a href=\"http:\/\/christianfighterpilot.com\/blog\/2010\/04\/23\/franklin-graham-and-military-religious-freedom-continued\/\">has been used to call the NDoP itself &#8220;unConstitutional:&#8221;<\/a><\/p>\n<blockquote><p>Sec. 119. National Day of Prayer<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0 The President shall issue each year a proclamation designating the first Thursday in May as a National Day of Prayer on which the people of the United States <strong>may turn to God in prayer<\/strong> and meditation at churches, in groups, and as individuals.<\/p><\/blockquote>\n<p>In fact, the Memorial Day text is <em>more<\/em> specific, even suggesting the content of the prayers of the people.<\/p>\n<p>To be sure, Memorial Day itself\u00a0(separate from the President&#8217;s call for prayer) can be described as having a &#8220;secular purpose&#8221; (ie, patriotism, remembering America&#8217;s fallen), and that is what would likely protect it from the same outcome as the NDoP.\u00a0 Still, it is an interesting exercise to observe the American government&#8217;s (seemingly) self-contradictory statements; &#8220;endorsing&#8221; prayer in one case is unConstitutional, in another it is not &#8212; even though the text is essentially the same.<\/p>\n<p>It is also interesting that Memorial Day was one of the few American holidays <em>not<\/em> mentioned in the NDoP lawsuit, even though it was quite relevant.\u00a0 (For example, the judge said there was &#8220;no other instance in which Congress has endorsed a particular religious practice in a statute,&#8221; which in fact the Memorial Day statute appears to do, using the same definitions.)<\/p>\n<p>Religious sentiment is found throughout the American government, including the military, as it has been for centuries.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>It may come as a surprise to some that Memorial Day, as proclaimed by\u00a0the President,\u00a0is unConstitutional &#8212; at least by some people&#8217;s\u00a0logic.
