{"id":4852,"date":"2010-04-26T00:35:19","date_gmt":"2010-04-26T08:35:19","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=4852"},"modified":"2015-06-27T19:16:13","modified_gmt":"2015-06-27T22:16:13","slug":"jpl-lawsuit-claims-religious-discrimination","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2010\/04\/26\/jpl-lawsuit-claims-religious-discrimination\/","title":{"rendered":"JPL Lawsuit Claims Religious Discrimination"},"content":{"rendered":"<p>An interesting <a href=\"http:\/\/www.evolutionnews.org\/2010\/04\/discrimination_lawsuit_filed_a.html\">lawsuit has been filed against the Jet Propulsion Laboratory<\/a> and CalTech after an employee was reportedly demoted and reprimanded for handing out DVDs at work.<\/p>\n<p>David Coppedge <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/jplsuit.pdf\">sued JPL (pdf)<\/a> claiming harassment and religious discrimination.\u00a0 Coppedge had reportedly distributed copies of two DVDs that supported the concept of Intelligent Design to &#8220;interested&#8221; and &#8220;willing coworkers.&#8221;\u00a0 The DVDs themselves make no reference to religion, though his supervisors reportedly said they &#8220;amounted to &#8216;pushing religion&#8217; and were &#8216;unwelcome&#8217; and &#8216;disruptive.'&#8221;\u00a0 Coppedge notes that no one ever expressed those sentiments to him prior to his reprimand;\u00a0he was told it was his responsibility to correctly &#8220;interpret a co-worker&#8217;s &#8220;body language.&#8221;&#8221;\u00a0 The written warning threatening termination <!--more-->that Coppedge received was reportedly withdrawn a year later and called &#8220;inappropriate&#8221; by the very people who issued it.\u00a0 However, he did not regain the leadership position he lost.<\/p>\n<p>JPL is technically run by CalTech; however, they operate it under federal funding.\u00a0 Thus, the case has the potential of touching on government interaction with employee beliefs and peer interaction&#8211;which could influence the interaction of faith and the US military.\u00a0 It is also interesting that while Coppedge is alleging religious discrimination, he says <em>JPL<\/em> perceived his viewpoint to be religious, not him.\u00a0 According to the filing, since they were <em>acting<\/em> on the belief they were restricting religious expression,\u00a0then they were discriminating on the <em>basis<\/em> of religion.<\/p>\n<p>This may have an interesting application to faith in the US military.\u00a0 The complaint does not indicate\u00a0Coppedge misused his authority; instead, it appears his interactions were after work hours and in essentially peer relationships.\u00a0 Military leadership has repeatedly emphasized that &#8220;restrictions&#8221; or &#8220;cautions&#8221; on associating religion with the military <em>do not<\/em> apply to &#8220;peer to peer&#8221; discussions.\u00a0 The military has only been concerned with the misuse of <em>authority<\/em>, not casual conversations among similarly ranked individuals.<\/p>\n<p>This case, however, may demonstrate an attempt by a government-supported agency to restrict even peer-to-peer discussions about religion.\u00a0 This is not unforeseen, and is even supported by at least one outside organization.\u00a0 For example, speaking about a military Chaplain&#8217;s sermon, Chris Rodda of the MRFF recently said<\/p>\n<blockquote><p>On the one hand, evangelizing is part of the Christian faith, so the chaplain has the right to talk about it in a worship service, but on the other hand, the chaplain&#8217;s military congregation does not have the right do what the chaplain is encouraging them to do &#8212; evangelize in the military workplace.<\/p><\/blockquote>\n<p>Rodda is wrong.\u00a0 Outside of positions of authority, military men and women <em>can<\/em> share their ideological beliefs with their peers, even &#8220;in the military workplace.&#8221;\u00a0 The <a href=\"http:\/\/www.christianfighterpilot.com\/religionandmilitary.htm#af\">original Air Force guidelines<\/a> on religion specifically said<\/p>\n<blockquote><p>Nothing in this guidance should be understood to limit voluntary, peer to peer discussions.<\/p><\/blockquote>\n<p>The <a href=\"http:\/\/www.christianfighterpilot.com\/religionandmilitary.htm#af\">updated guidelines<\/a> expanded on this, saying<\/p>\n<blockquote><p>Nothing in this guidance should be understood to limit the substance of voluntary discussions of religion, or the exercise of free speech, where it is reasonably clear that the discussions are personal, not official, and they can be reasonably free of the potential for, or appearance of, coercion.<\/p><\/blockquote>\n<p>Still, Rodda &#8212; representing a &#8220;religious freedom&#8221; group &#8212; claims that such discussions are not permitted.\u00a0 She provides no support for her incorrect assertion.<\/p>\n<p>If Coppedge&#8217;s case remains one of voluntary discussions separate from authority, it\u00a0has\u00a0the potential to impact even casual conversation in the military on topics of religion.<\/p>\n<p><span style=\"font-size: xx-small;\">Also noted at the <a href=\"http:\/\/religionclause.blogspot.com\/2010\/04\/nasa-employee-sues-for-religious.html\">Religion Clause<\/a>.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>An interesting lawsuit has been filed against the Jet Propulsion Laboratory and CalTech after an employee was reportedly demoted and reprimanded for handing out DVDs at work.
