{"id":45549,"date":"2020-09-21T13:42:38","date_gmt":"2020-09-21T16:42:38","guid":{"rendered":"http:\/\/christianfighterpilot.com\/?p=45549"},"modified":"2020-09-21T13:49:14","modified_gmt":"2020-09-21T16:49:14","slug":"us-military-publishes-major-revision-to-religious-liberty-rules","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2020\/09\/21\/us-military-publishes-major-revision-to-religious-liberty-rules\/","title":{"rendered":"US Military Publishes Major Revision to Religious Liberty Rules"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-30209 size-full\" src=\"http:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2014\/10\/080323-N-4776G-024.jpg\" alt=\"\" width=\"650\" height=\"426\" srcset=\"https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2014\/10\/080323-N-4776G-024.jpg 650w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2014\/10\/080323-N-4776G-024-300x196.jpg 300w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2014\/10\/080323-N-4776G-024-624x408.jpg 624w\" sizes=\"auto, (max-width: 650px) 100vw, 650px\" \/><\/p>\n<p>The US military has just updated its regulations with the intent of improving the protection of military religious freedom.<\/p>\n<p>Department of Defense Instruction (DoDI) 1300.17 was previously known as \u201cAccommodation of Religious Practices Within the Military Services,\u201d but is now re-titled simply \u201c<a href=\"https:\/\/www.esd.whs.mil\/Portals\/54\/Documents\/DD\/issuances\/dodi\/130017p.pdf\">Religious Liberty in the Military Services<\/a>\u201d (<a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/DODI-1300.17-Sept-1-2020.pdf\">PDF<\/a>). The new DoDI title sets the tone for a policy that <em>presupposes<\/em> religious liberty, rather than treats it as an outlier that may sometimes be \u201caccommodated.\u201d<\/p>\n<p>That change in tone mimics the tone change in religious liberty policies in the Air Force \u2013 which may not be a coincidence. The new DoDI was approved by Undersecretary of Defense <a href=\"https:\/\/prhome.defense.gov\/Leadership\/MatthewDonovan\/\">Matthew Donovan<\/a> \u2013 a former Air Force <a href=\"https:\/\/www.af.mil\/About-Us\/Biographies\/Display\/Article\/1270457\/acting-secretary-of-the-air-force-matthew-p-donovan\/\">fighter pilot who has been both<\/a> an Undersecretary of the Air Force and even the Acting Secretary of the Air Force in the past few years, during which the tenor (if not always the actions) of Air Force policy leaned toward religious freedom.<\/p>\n<p>It seems President Trump\u2019s selection of Undersecretary Donovan may have set the stage for improving religious liberty in the US military.<\/p>\n<p>As to the DoDI itself, it notably <!--more-->requires the Service Secretaries to institute training programs on religious accommodation, which is essentially the NDAA language Chris Rodda lamented <a href=\"http:\/\/christianfighterpilot.com\/2020\/07\/07\/chris-rodda-us-troops-can-proselytize-with-this-one-neat-trick\/\">just a few months ago<\/a>.<\/p>\n<p>The new DoDI incorporates many of the previous mandates and policies, including use of peyote, the Religious Freedom Restoration Act, and religious pre-accession policies (pre-enlistment and officer commissioning). Generally, the changes are few and subtle. For example, the old regulation specifically called out religious \u201cjewelry\u201d (and said the same rules apply as any other jewelry). The new regulation includes religious jewelry in the category of \u201creligious apparel\u201d and automatically provides permission to wear it, barring the standard restrictions of being able to perform duties and the apparel being \u201cneat and conservative.\u201d While that would explicitly permit most rings and necklaces with crosses, for example, there is a specific prohibition on attachment to the uniform \u2013 which would seem to ban religious patches sometimes velcroed onto an Airman\u2019s flight suit.<\/p>\n<p>The definitions are also where Michael \u201cMikey\u201d Weinstein takes the greatest umbrage. Chris Rodda, Weinstein\u2019s research assistant, noted that \u201creligious practice\u201d (which was previously undefined) is now specifically defined to include \u201cbehavior\u201d and \u201cconduct\u201d. The definition reads:<\/p>\n<blockquote><p>An action, behavior, or course of conduct constituting individual expressions of religious beliefs, whether or not compelled by, or central to, the religion concerned.<\/p><\/blockquote>\n<p>This put Rodda into <a href=\"https:\/\/www.dailykos.com\/stories\/2020\/9\/17\/1978097\/-Trump-Defense-Dept-Appointee-Changes-Military-Religion-Regulations-to-Allow-Just-About-Anything#comment_78592668\">a dither<\/a>:<\/p>\n<blockquote><p>Behavior and conduct? This could include just about anything. Is God motivating you to proselytize your fellow service members? Go ahead! That\u2019s \u201cconduct motivated by a sincerely held religious belief.\u201d Want to pray loudly at your desk? No problem! That\u2019s just behavior \u201cconstituting individual expressions\u201d of your religious beliefs!<\/p><\/blockquote>\n<p>Volume notwithstanding, why does Chris Rodda have a problem with people praying at their desk? Regardless, Rodda and Weinstein are probably worried because, if military leaders actually follow this regulation, it will end many of their public relations campaigns before they start. Now, if the MRFF wants to make hay out of attacking military members like Col\u00a0<strong><a href=\"http:\/\/christianfighterpilot.com\/2017\/10\/16\/air-force-fires-col-leland-bohannon-for-not-affirming-homosexual-marriage\/\">Leland Bohannon<\/a><\/strong>,\u00a0LtGen\u00a0<strong><a href=\"http:\/\/christianfighterpilot.com\/2017\/10\/19\/mikey-weinstein-accuses-air-force-jag-of-being-a-christian\/\">Chris Burne<\/a><\/strong>, Chaplain\u00a0<strong><a href=\"http:\/\/christianfighterpilot.com\/2015\/09\/07\/navy-reverses-rules-for-embattled-chaplain-modder\/\">Wes Modder<\/a><\/strong>, Chaplain\u00a0<a href=\"http:\/\/christianfighterpilot.com\/2017\/10\/02\/politician-pastor-speaks-out-in-defense-of-sonny-hernandez\/\"><strong>Sonny Hernandez<\/strong><\/a><strong>,<\/strong>\u00a0LtGen\u00a0<a href=\"http:\/\/christianfighterpilot.com\/2017\/01\/23\/mikey-weinstein-demands-aggressive-punishment-after-ltgen-steven-kwast-mentions-god\/\"><strong>Steven Kwast<\/strong><\/a><strong>,<\/strong>\u00a0LtCol\u00a0<a href=\"http:\/\/christianfighterpilot.com\/2016\/10\/24\/col-john-walker-at-incirlik-air-base-delivers-outstanding-response-to-mikey-weinstein\/\"><strong>Michael Kersten<\/strong><\/a><strong>,<\/strong>\u00a0MajGen\u00a0<a href=\"http:\/\/christianfighterpilot.com\/2017\/03\/20\/general-julie-bentz-prays-for-her-troops-so-mikey-weinstein-wants-her-fired\/\"><strong>Julie Bentz<\/strong><\/a>, Maj <a href=\"http:\/\/christianfighterpilot.com\/2015\/08\/12\/mikey-weinstein-attacks-air-force-christians-for-their-faith\/\"><strong>Christina Hopper<\/strong><\/a><strong>,<\/strong> Lt <a href=\"http:\/\/christianfighterpilot.com\/2015\/08\/12\/mikey-weinstein-attacks-air-force-christians-for-their-faith\/\"><strong>Austin Krohn<\/strong><\/a>\u00a0\u2013 yes, it\u2019s a long list, and that\u2019s not even all of them \u2013 there will be an immediate, <em>default<\/em> response that, to borrow Chris Rodda\u2019s words, \u201creligious behavior is the rule rather than the exception.\u201d And that\u2019s precisely how a constitutionally-protected right <em>should<\/em> be viewed by the government.<\/p>\n<p>In other words, if applied correctly, the new DoDI 1300.17 <strong>protects military religious freedom<\/strong>. Odd that the Military <em>Religious Freedom<\/em> Foundation is so upset about that, isn\u2019t it? Said <a href=\"https:\/\/www.dailykos.com\/stories\/2020\/9\/17\/1978097\/-Trump-Defense-Dept-Appointee-Changes-Military-Religion-Regulations-to-Allow-Just-About-Anything#comment_78592668\">Mikey Weinstein<\/a>:<\/p>\n<blockquote><p>MRFF will fight tooth and nail, day and night to stop this new, twisted and perverted version of DoD Instruction 1300.17. Indeed, MRFF will never allow this brand new regulatory provision to illicitly buttress the already repugnant and omnipresent efforts of the fundamentalist Christian religious right from perpetuating its pervasive and pernicious pattern and practice of forcing its weaponized version of the Gospel of Jesus Christ upon otherwise defenseless military subordinates.<\/p><\/blockquote>\n<p>Interestingly, Weinstein has exactly zero examples of anyone \u201cforcing [their] weaponized version of the Gospel of Jesus Christ upon otherwise defenseless military subordinates,\u201d despite his claim it is \u201comnipresent.\u201d In many of the attacks against military Christians noted above, Weinstein was offended only because the military member spoke of the value of God to his life. That, to him, is apparently \u201cweaponized\u201d Christianity.<\/p>\n<p>Though the new regulation does make some strong statements on religious liberty, it remains to be seen if the conduct of the DoD will follow. (As with prior legislative and policy victories for military religious freedom, the tone from some advocates seems to be a bit of \u201c<a href=\"http:\/\/christianfighterpilot.com\/2014\/11\/25\/us-air-force-revises-religious-guidelines\/\">wait and see how its implemented<\/a>.\u201d) For comparison, Donovan was Undersecretary of the Air Force when Colonel Leland Bohannon was fired in 2018 for not personally signing a spouse appreciation certificate. (The &#8220;spouse&#8221; was homosexual, so Col Bohannon would have been legitimizing a relationship contrary to his faith). Despite the fact Air Force policies in place at the time should <em>already<\/em> have protected Col Bohannon, that travesty against religious liberty was not reversed until it made it to the office of Donovan and his boss, then-Air Force Secretary Heather Wilson. In other words, policy alone is insufficient. Leaders within the force must <em>follow<\/em> it.<\/p>\n<p>As an aside, it was interesting to see the list of references, which was moved to the end of the document in what appears to be an updated regulatory format.
