{"id":45477,"date":"2020-07-13T17:23:41","date_gmt":"2020-07-13T20:23:41","guid":{"rendered":"http:\/\/christianfighterpilot.com\/?p=45477"},"modified":"2020-07-13T22:48:04","modified_gmt":"2020-07-14T01:48:04","slug":"us-navy-relents-as-group-defends-military-religious-freedom","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2020\/07\/13\/us-navy-relents-as-group-defends-military-religious-freedom\/","title":{"rendered":"US Navy Relents as Group Defends Military Religious Freedom"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-40801\" src=\"http:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/05\/navysub.jpg\" alt=\"\" width=\"880\" height=\"280\" srcset=\"https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/05\/navysub.jpg 880w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/05\/navysub-300x95.jpg 300w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/05\/navysub-768x244.jpg 768w\" sizes=\"auto, (max-width: 880px) 100vw, 880px\" \/>Though it occurred somewhat under the radar these past two weeks, new US military policies clashed with religious freedom, resulting in outside groups coming to the aid of US troops and their liberties.<\/p>\n<p>Late in June, the US Navy Fleet Forces Command, which administratively oversees Naval forces based within the continental United States, issued \u201c<a href=\"https:\/\/nps.edu\/covid19\">additional Force Health Protection guidance<\/a>\u201d regarding COVID-19 mitigation procedures. In theory, Fleet Forces Command had <em>already<\/em> declared \u201c<a href=\"https:\/\/www.whs.mil\/Portals\/75\/Coronavirus\/ANNEX%20L-HPCON%20Levels%20-%20Review3.pdf?ver=2020-03-09-165325-583\">HPCON<\/a> C minus\u201d in <a href=\"https:\/\/www.navy.mil\/submit\/display.asp?story_id=112415\">late March<\/a>, and the late June message was a \u201creiteration\u201d or <a href=\"https:\/\/www.wtkr.com\/news\/military\/navy-reminds-sailors-of-covid-19-restrictions-as-virginia-continues-to-reopen\">reminder<\/a> of that status. However, the latest release was notable (making <a href=\"https:\/\/www.wxxv25.com\/2020\/06\/24\/new-frago-detailing-isnt-allowed-hits-streets\/\">the local news<\/a> in many places) and very specifically clarified the somewhat vague <a href=\"https:\/\/www.defense.gov\/Explore\/Inside-DOD\/Blog\/Article\/2128863\/hpcon-understanding-health-protection-condition-levels\/\">HPCON<\/a> C- with detailed mandatory procedures and prohibitions \u2013 including a specific statement on religious services \u2013 even those <em>off<\/em> military installations.<\/p>\n<p>As printed in the Navy message (<a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/navyfrag.pdf\">PDF<\/a>):<\/p>\n<blockquote><p>5.A.7.B.4. (U) <strong>SERVICE MEMBERS ARE PROHIBITED<\/strong> FROM VISITING, PATRONIZING, OR ENGAGING IN THE FOLLOWING <strong>OFF-INSTALLATION<\/strong> SPECIFIC FACILITIES, SERVICES, OR ACTIVITIES\u2026<\/p>\n<p>5.A.7.B.4.F. (U) DINE-IN RESTAURANTS (TAKE-OUT AUTHORIZED), BARS, NIGHT CLUBS, CASINOS, CONFERENCES, SPORTING EVENTS, CONCERTS, PUBLIC CELEBRATIONS, PARADES, PUBLIC BEACHES, AMUSEMENT PARKS OR OTHER EVENTS DESIGNED TO PROMOTE LARGE GATHERINGS, <strong>TO INCLUDE INDOOR RELIGIOUS SERVICES<\/strong>.<\/p><\/blockquote>\n<p>While seemingly <!--more-->neutrally inclusive of all \u201clarge gatherings,\u201d the wording of the full order seemed to leave room allowing public protests, and it <em>specifically<\/em> permitted social gatherings in homes. If a group of people could gather in their private residence, why could they not gather in a church building?<\/p>\n<p>If a large group of people can board mass transit, while trying to adhere to social distancing and mask requirements, why can a church building not be open under the same?<\/p>\n<p>It would seem much of the rest of the DoD had already <a href=\"https:\/\/www.defense.gov\/Explore\/Features\/Story\/Article\/2268099\/chapels-at-camp-arifjan-reopen-for-in-person-gatherings\/\">come to the same conclusion<\/a>, so why did the Navy suddenly need to disagree?<\/p>\n<p>This was particularly relevant to US Air Force Major Daniel Schultz, who is attending the Naval Postgraduate School in an exchange position and thus subject to their restrictions. Major Schultz is a member of the worship team at his local church, meaning the order affects not only him, but also his congregation.<\/p>\n<p>First Liberty Institute <a href=\"https:\/\/firstliberty.org\/news\/court-martialed-for-church\/\">represented<\/a> Maj Schultz in filing (<a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2020\/06\/Maj-Schultz-Religious-Accom-Req-0629202013.pdf\">PDF<\/a>) a request for religious accommodation. After some <a href=\"https:\/\/www.military.com\/daily-news\/2020\/07\/08\/navy-ban-sailors-worshiping-indoors-off-base-churches-stirs-controversy.html\">initial resistance<\/a>, the Department of Defense issued a clarification, and the Navy <a href=\"https:\/\/www.foxnews.com\/us\/coronavirus-church-navy-restriction-update\">relented<\/a>. The Acting Under Secretary of the Navy issued a memorandum (<a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2020\/07\/SECDEF-MEMO.pdf\">PDF<\/a>) saying [emphasis added]<\/p>\n<blockquote><p>The [DoD] advised that nothing in the [Secretary of Defense pandemic guidance] should be <strong>construed to restrict attendance at places of worship<\/strong> where attendees are able to appropriately apply COVID-19 transmission mitigation measures\u2026<\/p>\n<p>Accordingly, <strong>I am directing you<\/strong>\u2026to inform Commanders to incorporate this clarification <strong>allowing attendance at religious services<\/strong> where COVID-19 transmission mitigation measures may be appropriately applied.<\/p><\/blockquote>\n<p>While that is the right ultimate outcome, as with many issues of religious freedom in the military, it should never have come to that. Apparently, the Navy has just provided further justification of the need for the Senate\u2019s <a href=\"http:\/\/christianfighterpilot.com\/2020\/07\/07\/chris-rodda-us-troops-can-proselytize-with-this-one-neat-trick\/\">proposed mandatory training on religious freedom<\/a> and the law.<\/p>\n<p>Note, too, that this was <strong>not<\/strong> an issue of a <em>Christian<\/em> being restricted from exercising their faith. This policy affected <strong>every faith<\/strong>: Catholics, Muslims, Jews, and Wiccans \u2013 well, unless the Wiccans were chanting outside, as they sometimes do. That said, <a href=\"https:\/\/www.milarch.org\/archbishop-broglio-issues-statement-on-u-s-naval-orders-prohibiting-participation-in-off-base-indoor-religious-services\/\">Archbishop Timothy Broglio noted<\/a> it might affect Catholics disproportionately, because they were less likely to be served by a military chaplain to begin with \u2013 meaning the policy effectively restricted them from any religious service. The same is true for minority faiths underserved by military chaplains. (Broglio <a href=\"https:\/\/www.milarch.org\/archbishop-broglio-welcomes-u-s-navy-policy-change-allowing-attendance-at-indoor-religious-services\/\">praised<\/a> the policy reversal.)<\/p>\n<p>A religious service is not a sporting event. There is no human or constitutionally-protected right to watch or participate in sports, while there most certainly is a human and constitutionally-protected right to participate in religious exercise. The Navy erred when it broadly restricted specifically religious gatherings. While the reversal \u2013 at the behest of the DoD \u2013 was appropriate, it should not have required an \u201caccommodation\u201d to begin with.<\/p>\n<p>It is true that some policies may unintentionally impact religious exercise, or only do so in an ancillary way. When that occurs, it is reasonable that someone might point out the second or third order effects to the office that wrote the policy, and then they would change it to rectify their error. Certainly, no one is perfect, and not everyone acts out of malice.<\/p>\n<p>This, however, was not a subtle reference. The policy specifically called out \u201creligious services.\u201d As soon as those words hit the Navy message text, it should have been obvious they needed a review of heightened scrutiny. That the US Navy had to be told by the US Department of Defense to correct their error, and that they did so only after a servicemember complained, both indicate the Navy\u2019s presumption is not that religious liberty should, in the norm, be both accommodated and protected.<\/p>\n<p>Unfortunately, it would seem there is more work to be done to protect military religious freedom. Fortunately, there are organizations like First Liberty who stand ready to help troops do that work.<\/p>\n<p>Did you notice, though, that despite the US military <strong>restricting free exercise of <em>all<\/em> religious faiths<\/strong> \u2013 including minority faiths \u2013 the self-proclaimed defender of military religious freedom, Michael \u201cMikey\u201d Weinstein, has been silent? It would seem that while other groups have stood to <em>defend<\/em> military religious freedom, Weinstein has been focused on a tattoo that no one can see under a civilian police officer\u2019s sleeve.<\/p>\n<p>Good thing US troops don\u2019t rely on Mikey to defend military religious freedom.
