SoS did have authorization to use the military trademarks, but the Army told SoS to stop to prevent the \u201cnegative press.\u201d A few weeks ago, the Marines did the same thing. First Liberty has come to <a href=\"http:\/\/christianfighterpilot.com\/2019\/12\/09\/religious-liberty-group-defends-religious-themed-dog-tags\/\">their defense<\/a>.<\/p>\n<p>In an op-ed published at the Military Times earlier this week, First Liberty\u2019s Mike Berry <a href=\"https:\/\/www.militarytimes.com\/opinion\/commentary\/2020\/01\/19\/anti-religion-group-seeks-to-deny-troops-inspirational-dog-tags\/\">told the story<\/a>:<\/p>\n<blockquote><p>Kenny Vaughan started Shields of Strength (\u201cSoS\u201d). SoS is a small, faith-based company from Texas that produces military-themed items inscribed with encouraging Bible verses. For more than two decades, Kenny has been making these inspirational replica dog tags for service members and first responders. To date, SoS has donated hundreds of thousands of its replica dog tags to military units\u2026<\/p>\n<p>Over the years, SoS replica dog tags became so popular and so nearly ubiquitous that, according to author and historian Stephen Mansfield, &#8220;aside from the official insignias they wear, [the SoS dog tag] is the emblem most often carried by members of the military in Afghanistan and Iraq.&#8221;<\/p><\/blockquote>\n<p>Berry and First Liberty sent <!--more-->letters to the Services explaining that the Services&#8217; conduct toward SoS is inappropriate, if not outright discriminatory. Shortly thereafter, US Congressional Representative Gregory Steube (R-FL) introduced legislation that would specifically direct the DoD to allow its trademarks on items associated with religion. <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/5657\/text\">The bill<\/a> would<\/p>\n<blockquote><p>direct the Secretary of Defense to revise and update the Department of Defense regulations to allow trademarks owned or controlled by the Department of Defense to be combined with religious insignia on commercial identification tags (commonly known as \u201cdog tags\u201d) and to be sold by lawful trademark licensees\u2026<\/p><\/blockquote>\n<p>The move flustered Mikey Weinstein and Chris Rodda. Rodda <a href=\"https:\/\/www.militarytimes.com\/opinion\/commentary\/2020\/01\/22\/the-real-reason-the-marine-corps-is-disallowing-shields-of-strengths-bible-verse-dog-tags\/\">took to the Op-Ed pages<\/a> herself to proclaim that Berry was being deceptive, because the dog tags were in \u201cviolation of military trademark regulations,\u201d which Rodda quotes thusly [her emphasis original]:<\/p>\n<blockquote><p>These are the restrictions, according to Department of Defense Instruction 5535.12, \u201cDoD Branding and Trademark Licensing Program Implementation,\u201d Section 2.d. of which states (emphasis added):<br \/>\n\u201cIn accordance with subpart 2635.702 of Title 5, Code of Federal Regulations (Reference (i)), DoD marks may not be licensed for use in a manner that creates a perception of DoD endorsement of any non-federal entity or its products and services. <strong>DoD marks may not be licensed for any purpose intended to promote<\/strong> ideological movements, sociopolitical change, <strong>religious beliefs<\/strong> (including non-belief), specific interpretations of morality, or legislative\/statutory change&#8230;\u201d<\/p><\/blockquote>\n<p>Rodda\u2019s summary [emphasis added]:<\/p>\n<blockquote><p>The Department of Defense trademark and licensing regulations are clear: you can\u2019t use official military emblems on <strong>items that promote religion<\/strong>.<\/p><\/blockquote>\n<p>For a moment, pretend Rodda is right, and that the use of the trademarks on items \u201cpromot[ing] religion\u201d is correctly prohibited.<\/p>\n<p>If that\u2019s the case, by Chris Rodda\u2019s own statement, Shields of Strength is free to continue producing the dog tags &#8212; because <strong>they don&#8217;t &#8220;promote religion.&#8221;<\/strong> They have Bible verses on them, certainly. But, despite the wailing of Rodda and Weinstein, a dog tag that says &#8220;I will be strong and courageous&#8221; no more promotes Judaism or Christianity than does the phrase &#8220;don\u2019t steal.&#8221; That the source of a phrase, mantra, or other quote may be a religious faith does not make the item on which it is seen a <em>promotion<\/em> of that faith.<\/p>\n<p>By Rodda&#8217;s logic, the Washington Monument would be a government promotion of religion, as it <a href=\"https:\/\/www.nps.gov\/wamo\/learn\/historyculture\/index.htm\">proclaims &#8220;Praise be to God.&#8221;<\/a><\/p>\n<p>Since religion is not <strong>promoted<\/strong> by the dog tags, the only point at issue is religious <strong>association<\/strong>.\u00a0 If the military trademarks can be associated with <em>other<\/em> <a href=\"https:\/\/www.priorservice.com\/index.html\">commercial products<\/a> and <a href=\"https:\/\/www.vetfriends.com\/catalog\/product-detail.cfm?id=14686&amp;source=googleshop&amp;gclid=Cj0KCQiAyKrxBRDHARIsAKCzn8wo7OBY3_14Y0PkI-Sv_Vox7JTJ7U8fyTAd33D8KqjdW6yvfZ3C_MUaAihgEALw_wcB\">novelty items<\/a> with quotes and <a href=\"http:\/\/www.americanmethod.com\/conservative_bumper_stickers\/category\/pro_military_troops_army_sticker_decal.html\">phrases<\/a> (and <a href=\"https:\/\/www.isellstickers.com\/i-sell-stickers-shop\/army-girlfriend-3x5-bumper-sticker-window-vinyl-decal\/\">others<\/a>), why not those whose inspiration is religious?<\/p>\n<p>Some of the MRFF\u2019s supporters are under the mistaken impression that Shields of Strength is not allowed to use the trademark at all, but SoS had the necessary permission to use it. The only question is whether or not the trademark can appear next to a sentence that may be connected to religion. With that knowledge, even a few MRFF supporters acknowledged the dangerous ground Rodda proposed \u2013 denying something to one person but not another based solely on a religious connection to the work. If the government can arbitrarily deny access to a group the MRFF opposes, what\u2019s to stop them from denying access to a group the MRFF supports?<\/p>\n<p>Rodda <a href=\"https:\/\/www.dailykos.com\/stories\/2020\/1\/21\/1912989\/-GOP-Rep-Introduces-an-Actual-Bill-to-Allow-Christian-Jewelry-Company-to-Make-Bible-Verse-Dog-Tags\">has mocked<\/a> First Liberty\u2019s defense of the religious viewpoint by asking the pejorative<\/p>\n<blockquote><p>Do Bible verses lose their meaning if they don\u2019t have government endorsement?<\/p><\/blockquote>\n<p>It\u2019s a <em>non sequitur<\/em>, since the mere proximity of a trademark with a Bible verse does not imply endorsement. As has been said here many times in the past, the fact that troops can visit a Burger King on military bases around the world but not a Wendy\u2019s does not mean Burger King is the recipient of a federal endorsement while Wendy&#8217;s is not. Mere association between an entity and the government is not endorsement.<\/p>\n<p>Or, to put it in more recent context, just because the Air Force is <a href=\"https:\/\/www.foxbusiness.com\/technology\/us-air-force-call-of-duty-sponsors\"><em>sponsoring<\/em> Call of Duty<\/a> does not mean the US government <em>endorses<\/em> everything Call of Duty represents.<\/p>\n<p>The only reason given by the government for their kowtowing to the MRFF has been the \u201cnegative press\u201d generated by Weinstein\u2019s whining \u2013 attention now far more outweighed by the negative press they\u2019ve received for <em>pulling<\/em> the dog tag permission. That\u2019s a weak position to begin with, and the thought of Congress intervening has Rodda and Weinstein worried.<\/p>\n<p>In past years, First Liberty and other religious freedom groups have been quite effective at getting the military\u2019s inappropriate treatment of religion \u2013 action taken at Mikey Weinstein\u2019s behest \u2013 reversed. That\u2019s the reason so many of Weinstein\u2019s press releases about his \u201cvictories\u201d read like an anonymous tip line: \u201cAn anonymous Service member at an anonymous location was being vaguely affronted by an anonymous superior, and MRFF saved the day!\u201d The claims are completely unverifiable, which is what Weinstein wants. When other people are able to look into his accusations, they\u2019ve been able to reverse his \u201cvictory\u201d into defeat. Congress has <a href=\"http:\/\/christianfighterpilot.com\/2014\/01\/23\/us-military-publishes-new-religious-freedom-guidance\/\">acted before<\/a> and required the DoD to respond, including specific laws governing the practice of religion in the military. Similarly, military leadership has <a href=\"http:\/\/christianfighterpilot.com\/2014\/11\/25\/us-air-force-revises-religious-guidelines\/\">stiffened its protections of religious liberty<\/a> in the face of public and congressional pressure brought by religious freedom groups. Both have happened as a result of Weinstein&#8217;s attacks, and both reactions weakened his position.<\/p>\n<p>With Congress now actively involved, Mikey Weinstein and Chris Rodda know their \u201cvictory\u201d is either short-lived or hollow.<\/p>\n<p>Why, though, is Mikey Weinstein so concerned about protecting military trademarks?<\/p>\n<p>More importantly, consider this: What does anyone gain by Shields of Strength being allowed to put a military trademark only on dog tags that <em>don\u2019t<\/em> have biblical quotes? Whose religious freedom or civil liberties benefit? What Service members benefit? What \u201charm\u201d is undone?<\/p>\n<p>What positive is added to the world by virtue of Weinstein\u2019s complaints about the dog tags?<\/p>\n<p>Think about that. That should give you an idea of what motivates him, and it isn\u2019t religious freedom.<\/p>\n<p><span style=\"font-size: xx-small;\">More at the <a href=\"https:\/\/www.frc.org\/updatearticle\/20200121\/tag-war\">Family Research Council<\/a>.
