{"id":43033,"date":"2018-03-26T00:30:53","date_gmt":"2018-03-26T03:30:53","guid":{"rendered":"http:\/\/christianfighterpilot.com\/?p=43033"},"modified":"2021-04-01T14:29:31","modified_gmt":"2021-04-01T17:29:31","slug":"in-clever-move-president-trump-rescinds-military-transgender-ban","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2018\/03\/26\/in-clever-move-president-trump-rescinds-military-transgender-ban\/","title":{"rendered":"In Clever Move, President Trump Rescinds Military Transgender Ban"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-46157\" src=\"http:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2018\/03\/trumpmattis.jpg\" alt=\"\" width=\"460\" height=\"259\" srcset=\"https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2018\/03\/trumpmattis.jpg 460w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2018\/03\/trumpmattis-300x169.jpg 300w\" sizes=\"auto, (max-width: 460px) 100vw, 460px\" \/>Though it isn&#8217;t being reported this way, last Friday President Trump actually <strong>rescinded<\/strong> the ban he previously implemented on transgenders in the military last August.\u00a0 The <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/transgendertrump.pdf\"><em>new<\/em> memorandum (PDF)<\/a>\u00a0explicitly withdrew his prior policy:<\/p>\n<blockquote><p>I hereby revoke my memorandum of August 25, 2017, &#8220;Military Service by Transgender Individuals,&#8221; and any other directive I may have made with respect to military service by transgender individuals.<\/p><\/blockquote>\n<p>The new memo did <strong>not<\/strong> institute a new presidential directive.\u00a0 Rather, the President deferred to the Department of Defense &#8212; that is, the &#8220;independent judgment&#8221; of the DoD &#8212; with regard to its policies.\u00a0 He said [emphasis added]:<\/p>\n<blockquote><p>These [DoD-produced] documents set forth the policies on this issue that the Secretary of Defense, in the exercise of <strong>his independent judgment<\/strong>, has concluded should be adopted by the Department of Defense.<\/p><\/blockquote>\n<p>It&#8217;s a clever move.\u00a0 Lawsuits and <!--more-->media attacks up to this point have focused on the President.\u00a0 Here, the President essentially &#8212; in fact, explicitly &#8212; says Secretary James Mattis of the <strong>DoD<\/strong> has made these policies, <strong>not<\/strong> him.\u00a0 This severely undercuts those who have made this issue about President Trump &#8212; and especially those who have tried to portray this as Trump <em>overruling<\/em> the DoD.\u00a0 President Trump isn&#8217;t going <em>against<\/em> the military; he&#8217;s letting <em>them<\/em> make the decision.<\/p>\n<p>The new <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/transgenderpolicy2018.pdf\">DoD policies (PDF)<\/a>\u00a0contain\u00a0<a href=\"http:\/\/www.foxnews.com\/politics\/2018\/03\/24\/president-trump-issues-order-to-ban-transgender-troops-from-service-except-in-limited-circumstances.html\">updated guidance<\/a>\u00a0on military service by individuals who are confused about their biological gender [emphasis added]:<\/p>\n<blockquote><p>&#8220;Among other things, the policies set forth by the Secretary of Defense state that transgender persons with a history or diagnosis of <strong>gender dysphoria<\/strong> &#8212; individuals who the policies state may require substantial medical treatment, including medications and surgery &#8212; <strong>are disqualified from military service<\/strong> except under certain limited circumstances,&#8221; a memo released by the White House on Friday night said.<\/p><\/blockquote>\n<p>Some of the same groups who complained Trump was ignoring DoD conclusions (when it favored their agenda) are now ignoring the latest statements by the same\u00a0DoD [emphasis added]:<\/p>\n<blockquote><p>&#8220;Based on the work of the Panel and the Department\u2019s best military judgment, <strong>the Department of Defense concludes<\/strong> that there are <strong>substantial risks<\/strong> associated with allowing the accession and retention of individuals with a history or diagnosis of gender dysphoria and require, or have already undertaken, a course of treatment to change their gender.<\/p>\n<p>&#8220;Furthermore, the Department also finds that exempting such persons from well-established mental health, physical health, and sex-based standards, which <strong>apply to all Service members<\/strong>, including transgender Service members without gender dysphoria, could <strong>undermine readiness<\/strong>, <strong>disrupt unit cohesion<\/strong>, and <strong>impose an unreasonable burden on the military<\/strong> that is <strong>not conducive to military effectiveness and lethality<\/strong>.&#8221;<\/p><\/blockquote>\n<p>Naturally, LGBT activist groups decried the policy, but they didn&#8217;t always think through what they were saying. For example,\u00a0the\u00a0AMPA &#8212; led by Ashley Broadway, the famous &#8220;<a href=\"http:\/\/christianfighterpilot.com\/2013\/01\/28\/military-spouse-of-the-year-devout-christian-homosexual\/\">devout Christian<\/a>&#8221;\u00a0&#8212; attacked President Trump (and Vice President Pence) and\u00a0<a href=\"http:\/\/militarypartners.org\/american-psychiatric-association-rebukes-trump-pence-transgender-military-ban\/\">applauded<\/a> the American Psychiatric Association&#8217;s statement,\u00a0highlighting this quote:<\/p>\n<blockquote><p>&#8220;All Americans who meet the strenuous requirements and volunteer to serve in U.S. military should be given the opportunity to do so.\u201d<\/p><\/blockquote>\n<p>That&#8217;s great, Ashley. Do you understand that <strong>not<\/strong> having <strong>gender dysphoria<\/strong> is one of those &#8220;strenuous requirements&#8221;? Seems like you actually <strong>support<\/strong> the DoD policy.<\/p>\n<p>Federal courts put a hold on the implementation of President Trump&#8217;s prior\u00a0policy, but the Justice Department has already indicated an intent to proceed &#8212; in fact, the memo was filed with the intent of ending the current legal cases. Historically, it seems unlikely LGBT advocates would prevail at the Supreme Court anyway, given the judiciary&#8217;s deference to the military on matters affecting national defense.<\/p>\n<p>First, as previously noted, this is now being presented as a DoD issue, not a President Trump issue.<\/p>\n<p>Second,\u00a0in the early 1980s the Supreme Court said the military could restrict a service member&#8217;s free exercise of religion &#8212; even though that&#8217;s an explicitly enumerated right in the US Constitution.<\/p>\n<p>By contrast, there is <strong>no<\/strong> right to serve in the US military. There is <strong>no<\/strong> right to have the government support your personal perception or feelings about your sexuality.<\/p>\n<p>There are actual, physical issues regarding these neo-sexual &#8220;rights&#8221; in the military, which even now society is struggling to handle. Similarly, there is again a nexus with religion. What of the US troop who believes he would be participating in sin to shower with someone who was biologically the other gender, but asserted a different gender? What of the troop who believed it morally wrong to support a &#8220;perversion&#8221; of God&#8217;s creation in calling a &#8220;male&#8221; a &#8220;female,&#8221; or vice versa?<\/p>\n<p>It&#8217;s <em>not<\/em> a non-event.<\/p>\n<p>If the Supreme Court wouldn&#8217;t &#8220;protect&#8221; an <em>actual<\/em> right, why do sexual activists think SCOTUS would protect a manufactured one?<\/p>\n<p>Then again, you never know.<\/p>\n<p>For those that still don&#8217;t get it, a military father articulately explained it this way:<\/p>\n<blockquote><p>I have a Deaf son and daughter. They cannot serve in the military. Do I personally wish they could? Of course, I love the Army and what it has done in my life, I would love for them to have every opportunity I have had because I\u2019m their dad.<\/p>\n<p>But I\u2019m also a leader. I\u2019m also responsible for ensuring our lethality. I\u2019m aware that just because my amazing Deaf children would be capable of serving doesn\u2019t mean that\u2019s what\u2019s right for the Army as an organization.<\/p>\n<p>The military isn\u2019t about individual expression, it\u2019s about service to our nation and not about our nation serving us.<\/p>\n<p>This is 100% the right move by Chaos 6. There are plenty of other opportunities available to serve our Nation available to my children if they do choose. Range control to health care to DOIM. The list is almost endless of jobs they can do, with shoot move and communicate as a team not being there.<\/p>\n<p>I\u2019m okay with that. I get it. I get that our national security is worth that conversation I will have to have with them about why Daddy could serve in uniform and they can\u2019t.<\/p>\n<p>So <strong>to all the transfolk our there I say, it\u2019s not about you. It\u2019s not about your \u201crights\u201d as a trans person because no one has a right to serve. It is a privilege of the few. Feel a little raw about it? Plenty of jobs at range control, health care, DOIM, etc<\/strong>.<\/p>\n<p>We don\u2019t all get a choice to void our ability to serve.
