{"id":42548,"date":"2018-01-03T00:15:49","date_gmt":"2018-01-03T03:15:49","guid":{"rendered":"http:\/\/christianfighterpilot.com\/?p=42548"},"modified":"2018-01-03T00:28:33","modified_gmt":"2018-01-03T03:28:33","slug":"fired-fire-chief-kelvin-cochran-wins-lawsuit-against-atlanta","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2018\/01\/03\/fired-fire-chief-kelvin-cochran-wins-lawsuit-against-atlanta\/","title":{"rendered":"Fired Fire Chief Kelvin Cochran Wins Lawsuit Against Atlanta"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-42585\" src=\"http:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/12\/cochran-215x300.jpg\" alt=\"\" width=\"215\" height=\"300\" srcset=\"https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/12\/cochran-215x300.jpg 215w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/12\/cochran.jpg 640w\" sizes=\"auto, (max-width: 215px) 100vw, 215px\" \/>Just before Christmas, a Federal district court <a href=\"http:\/\/adflegal.org\/detailspages\/press-release-details\/court-says-atlanta-policies-violate-first-amendment-freedoms-of-former-fire-chief-others?keyword=atlanta%20fire%20chief%20fired&amp;b&amp;g&amp;241259309205&amp;1t1&amp;c&amp;969438954&amp;53681657252&amp;sourcecode=05QJ0004&amp;gclid=EAIaIQobChMImfSb35uw2AIVUiSBCh3ypAs3EAAYASAAEgIrO_D_BwE\">ruled<\/a> in the case of <em>Cochran v City of Atlanta<\/em>, in which Fire Chief Kelvin Cochran had <a href=\"http:\/\/christianfighterpilot.com\/2015\/01\/12\/atlanta-fire-chief-kelvin-cochran-fired-for-religious-views\/\">claimed he was fired<\/a> because he did nothing more than write a book &#8212; one that included a page with his Christian beliefs about homosexuality.<\/p>\n<p>You&#8217;d be forgiven for not realizing that, given that the ruling on the\u00a0three-year-old case seems to have garnered little to no press attention, despite its potentially significant impact\u00a0on\u00a0religious liberty.<\/p>\n<p>Part of the reason for the seeming indifference may be the ruling itself. The court denied most of Cochran&#8217;s constitutional claims but found in his favor on the unconstitutionality of the City&#8217;s policies requiring &#8220;pre-clearance&#8221; before writing a book. (That apparent\u00a0ambiguity may be why some outlets appear to have said the Court &#8220;<a href=\"https:\/\/www.bizjournals.com\/atlanta\/news\/2017\/12\/20\/court-upholds-firing-of-former-atlanta-fire-chief.html\">sided with Atlanta<\/a>,&#8221; which belies the fact\u00a0Atlanta was <em>defending<\/em> and did <strong>not<\/strong> prevail in its defense &#8212; meaning the Court <em>actually<\/em> sided with Cochran.)<\/p>\n<p>In its legal filings, the City claimed it fired Cochran <!--more-->because of the issue of pre-clearance &#8212; and not because of his beliefs. Thus, on what even the City admits was the core constitutional issue related to his firing, Cochran won.<\/p>\n<p>There is some concern, however, in the way the court tossed out the other constitutional claims. For example, in granting the City&#8217;s position on some of the other points, the Court essentially said any individual person&#8217;s <strong>potential offense<\/strong> &#8212; even <em>deceitful<\/em> and <em>manufactured<\/em> offense &#8212; was sufficient justification for the City to act against Cochran [emphasis added]:<\/p>\n<blockquote><p>It is also reasonably possible that an employee would have <strong>used the book as purported evidence<\/strong> of discriminatory animus going forward, even if that employee <strong>did not suffer <span style=\"text-decoration: underline;\">actual discrimination<\/span><\/strong>&#8230;<\/p>\n<p>The Court could foresee individuals who might contend their fire department response time was not sufficient because of their sexual orientation or otherwise, <strong>regardless of the veracity of that claim<\/strong>.<\/p><\/blockquote>\n<p>That asinine logic takes the heckler&#8217;s veto &#8212; no, the <a href=\"http:\/\/christianfighterpilot.com\/2016\/08\/04\/aclj-rebuts-mikey-weinstein-and-the-ignoramus-veto\/\">ignoramus&#8217; veto<\/a> &#8212; to a whole new level. The idea that the government should proactively restrict an individual citizen&#8217;s liberty because <em>another<\/em> person <em>might<\/em> <strong>possibly,<\/strong> and <strong>falsely,<\/strong> claim discrimination is beyond the pale.<\/p>\n<p>Apply that logic to the military:\u00a0 Should a military officer who is a &#8220;known&#8221; Christian be allowed to command a unit &#8212; if, <strong>possibly,<\/strong> one of his subordinates might <strong>falsely<\/strong> claim animus or discrimination because of their preferred sexuality?<\/p>\n<p>That&#8217;s an argument that should fall on its face, yet it is the one presented as a legal conclusion by a judge.\u00a0 It is also not hypothetical within in the US military.<\/p>\n<p>When the government &#8220;prohibits the free exercise thereof&#8221; to avoid someone being offended, it tramples on protected human rights to preserve someone&#8217;s personal feelings.<\/p>\n<p>For now, it seems Cochran has prevailed on the merits of being fired.
