{"id":39490,"date":"2017-01-06T00:30:44","date_gmt":"2017-01-06T03:30:44","guid":{"rendered":"http:\/\/christianfighterpilot.com\/?p=39490"},"modified":"2017-03-07T03:22:14","modified_gmt":"2017-03-07T06:22:14","slug":"us-army-to-grant-sikhs-muslims-jews-permanent-waivers","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2017\/01\/06\/us-army-to-grant-sikhs-muslims-jews-permanent-waivers\/","title":{"rendered":"US Army to Grant Sikhs, Muslims, Jews Permanent Waivers"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-39495\" src=\"http:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/01\/armypolicychange.jpg\" alt=\"\" width=\"878\" height=\"280\" srcset=\"https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/01\/armypolicychange.jpg 878w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/01\/armypolicychange-300x96.jpg 300w, https:\/\/christianfighterpilot.com\/blog\/wp-content\/uploads\/2017\/01\/armypolicychange-768x245.jpg 768w\" sizes=\"auto, (max-width: 878px) 100vw, 878px\" \/>The US Army has changed its <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/armydirective201703sikh.pdf\">policies (PDF)<\/a> to allow Sikhs,\u00a0Muslims, and Jews to serve\u00a0while wearing their religious accoutrements in uniform [emphasis added]:<\/p>\n<blockquote><p>Since 2009, religious accommodation requests requiring a waiver for uniform wear and grooming have largely fallen into one of three faith practices: the wear of a <strong>hijab<\/strong>; the wear of a <strong>beard<\/strong>; and the wear of a <strong>turban<\/strong> or under-turban\/patka, with uncut <strong>beard<\/strong> and uncut <strong>hair<\/strong>. Based on the successful examples of Soldiers currently serving with these accommodations, I have determined that brigade-level commanders may approve requests for these accommodations&#8230;<\/p><\/blockquote>\n<p>Importantly, the policy specifically says the religious practice should be approved <!--more--><\/p>\n<blockquote>\n<p align=\"LEFT\">regardless of whether the practice is compelled by, or central to, the religion concerned.<\/p>\n<\/blockquote>\n<p>The initial approval level is at the much-lower Brigade level (as opposed to the Pentagon level). Notably, the Army <strong>directs<\/strong> its commanders to <strong>approve<\/strong> these requests for religious accommodation, though it permits the Army to assess the &#8220;sincerity&#8221; of the beliefs and allows an exception for safety [emphasis added]:<\/p>\n<blockquote><p>The&#8230;commander <strong>will<\/strong> <strong>approve<\/strong> a request&#8230;<strong>unless<\/strong> the commander:<\/p>\n<p>(1) determines the request is not based on a <strong>sincerely held religious belief<\/strong>, or<br \/>\n(2) identifies a specific, <strong>concrete hazard<\/strong>&#8230;that cannot be mitigated by reasonable measures&#8230;<\/p><\/blockquote>\n<p>(Presumably, then, atheists won&#8217;t be able to request a religious exception\u00a0to wear a beard in their military uniform.)<\/p>\n<p>While approval is at a low level, if the commander believes the request should be denied, the request is elevated &#8212; and only the Secretary of the Army can authorize a denial. (For perspective, activists had hailed the decision to elevate discharge authority of homosexuals and transgenders to Service-secretary level as de facto approval, even before repeal.)<\/p>\n<p>In a significant step, the accommodation request is permanent, as opposed to by-assignment as had been previously approved for some Sikhs:<\/p>\n<blockquote><p>The accommodation will continue throughout the Soldier&#8217;s career and may not be permanently revoked or modified unless authorized by [the Secretary of the Army].<\/p><\/blockquote>\n<p>That said, Sikh groups still plan to press the Department of Defense to change the underlying policy, rather than requiring them to seek an <em>exception<\/em> to the policy. (Importantly, this policy change is limited to the Army.)<\/p>\n<p>While the wording is almost exclusively restricted to hair, hijabs, beards, and turbans, these policy changes are a significant victory for religious freedom.<\/p>\n<p>As with the tone of the <a href=\"http:\/\/christianfighterpilot.com\/2014\/11\/25\/us-air-force-revises-religious-guidelines\/\">Air Force&#8217;s updated policies<\/a>, which <strong>presume<\/strong> a need to accommodate religious belief, rather than requiring the <em>adherent<\/em> to <strong>justify<\/strong> his belief, the Army has <em>assumed<\/em>\u00a0a Soldier is entitled\u00a0to his religious practice, and the <em>Army<\/em> is the one that has to justify any restriction on such practice. The tone is so strong, in fact, that for these accommodations the third-in-command to the President of the United States is the only one who can deny such a request.<\/p>\n<p>The Becket Fund for Religious Liberty, a religious civil liberties group that has been working on this issue for a long time, praised the move:<\/p>\n<blockquote><p>\u201cAn Army with Sikhs is an even stronger Army,\u201d Eric Baxter, senior counsel at Becket [Fund]&#8230;<\/p><\/blockquote>\n<p>Douglas Carver, former retired Major General and Chief of Chaplains for the Army, is now an endorser for the Southern Baptist Convention &#8212; and he <a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2017\/01\/coming-soon-to-the-us-army-turbans-beards-hijabs-and-cornrows\/512204\/\">praised the new policy<\/a>:<\/p>\n<blockquote><p>Faith is a major part of many service members\u2019 lives&#8230; \u201cYou are prepared to go into harm\u2019s way, even to die, and practice of your religious belief brings courage and calmness,\u201d he said. \u201cA soldier should not have to feel that he\u2019s about to give his life for his country, but that he doesn\u2019t want to compromise his individual faith or practices.\u201d<\/p><\/blockquote>\n<p>The Army&#8217;s high-level and fairly unequivocal\u00a0support\u00a0for military religious freedom may also explain the response (or lack thereof) from Michael &#8220;Mikey&#8221; Weinstein and his awkwardly named &#8220;Military Religious Freedom Foundation.&#8221; Over the years Weinstein has been largely silent on the issue of Sikhs in the military, and despite his constant threats to sue the US military over religious freedom, he did not participate in the <a href=\"http:\/\/christianfighterpilot.com\/2016\/04\/04\/military-grants-one-sikh-exemption-three-more-file-lawsuit\/\">Sikh lawsuit<\/a> against the Army.\u00a0At best, despite the clear issue of military religious freedom, Weinstein has only rarely expressed <a href=\"http:\/\/www.csmonitor.com\/USA\/USA-Update\/2014\/1115\/Sikh-student-sues-Army-over-religious-Catch-22-in-ROTC-enlistment\">tepid, and heavily qualified, support<\/a> for Sikhs in the military (in contrast to his <em>very<\/em> vocal support of homosexuals).<\/p>\n<p>The reason is almost certainly that <em>everyone<\/em> benefits from these policies &#8212; Christians included &#8212; and this policy change undermines some of the very methods Mikey Weinstein has used to attack Christians in the military. If Sikhs are allowed to express their religion so visibly &#8212; by wearing a beard and turban &#8212; how can Mikey Weinstein complain about an officer having a <a href=\"http:\/\/christianfighterpilot.com\/2016\/08\/24\/air-force-major-steve-lewis-can-keep-his-bible-on-his-desk\/\">Bible on his desk<\/a> or saying &#8220;<a href=\"http:\/\/christianfighterpilot.com\/2016\/10\/24\/col-john-walker-at-incirlik-air-base-delivers-outstanding-response-to-mikey-weinstein\/\">I&#8217;m a Christian<\/a>?&#8221;<\/p>\n<p>Weinstein previously justified his accusations by implying US troops were <a href=\"http:\/\/christianfighterpilot.com\/2015\/08\/04\/military-general-cautioned-to-avoid-attending-chapel\/\">sycophants<\/a> and <a href=\"http:\/\/christianfighterpilot.com\/2016\/04\/29\/mikey-weinstein-thinks-us-marines-are-stupid-cowards\/\">cowards<\/a>: He and his supporters implied if troops knew their commander was a Christian, they would be &#8220;coerced&#8221; to be or act like Christians, either to ingratiate themselves or because they were afraid to be different.<\/p>\n<p>Now, if a superior stands up and says nothing &#8212; but sports a beard, turban, or hijab &#8212; what can Weinstein say?<\/p>\n<p>Weinstein will, again, likely remain largely silent on the issue of Sikhs. It is more likely a few militant atheists will complain it isn&#8217;t fair they&#8217;re not allowed to wear beards or do-rags in uniform. While some government offices have granted atheists &#8220;religious&#8221; exemptions &#8212; a spate of <a href=\"http:\/\/christianfighterpilot.com\/2015\/08\/20\/coast-guardsman-receives-pastafarian-gift-at-retirement\/\">ridiculous headgear<\/a>\u00a0is <em>de rigueur<\/em> &#8212; the US military has not demonstrated such a whimsical attitude toward the clear constitutional protections of <em>religious<\/em> exercise.<\/p>\n<p>Allowing Sikhs to serve in the US Army while continuing to exercise their religious faith is a significant step in the right direction, and outgoing Secretary Eric Fanning should be commended for it.
