{"id":31453,"date":"2015-04-30T00:25:06","date_gmt":"2015-04-30T03:25:06","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=31453"},"modified":"2016-11-25T00:25:36","modified_gmt":"2016-11-25T03:25:36","slug":"mikey-weinsteins-lawyer-botches-complaint","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2015\/04\/30\/mikey-weinsteins-lawyer-botches-complaint\/","title":{"rendered":"Mikey Weinstein&#8217;s Lawyer Botches Complaint"},"content":{"rendered":"<p>A week ago, Michael &#8220;Mikey&#8221; Weinstein complained to US Navy CAPT Douglas Pfeifle that he was &#8220;<a href=\"http:\/\/christianfighterpilot.com\/blog\/2015\/04\/27\/navy-cancels-some-boot-camp-chapel-services\/\">essentially spiritually raping<\/a>&#8221; his recruits after civilian chapel volunteers were summarily banned from the base earlier this month. CAPT Pfeifle <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/rtcletter1.pdf\">replied<\/a> to Weinstein the next day, saying he&#8217;d get back to him. A week later, with no response, Weinstein attempted to up the ante by having an <em>actual<\/em> lawyer write a <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/rtcletter2.pdf\">letter<\/a> to CAPT Pfeifle, claiming there was a &#8220;constitutional question&#8221; with the Recruit Training Command&#8217;s action [emphasis added]:<\/p>\n<blockquote><p>There is a constitutional question whether denying similarly situated individuals under your command substantially similar rights to exercise religious freedoms <strong>violates the right to equal protection under the Fifth Amendment<\/strong> of the Constitution of the United States.<\/p><\/blockquote>\n<p>You don&#8217;t even have to crack out your high school American government books to see the error from Weinstein&#8217;s presumably high-brow lawyer. The <a href=\"https:\/\/www.law.cornell.edu\/wex\/fifth_amendment\">Fifth Amendment<\/a> contains important protections of citizens&#8217; rights, but it has nothing to do with &#8220;<a href=\"https:\/\/www.law.cornell.edu\/wex\/equal_protection\">equal protection<\/a>.&#8221; That&#8217;s the <em>Fourteenth<\/em> Amendment.<\/p>\n<p>The writer is Mr. <a href=\"http:\/\/teapartycheer.com\/bios\/midwest\/kansas\/bob-eye-ks-bio\/\">Robert Eye<\/a> of Kauffman-Eye, who <!--more-->has previously worked for Weinstein in the ill-fated <a href=\"http:\/\/christianfighterpilot.com\/blog\/2010\/01\/07\/atheist-lawsuit-against-us-military-dismissed\/\">Chalker<\/a> and <a href=\"http:\/\/christianfighterpilot.com\/blog\/2008\/10\/12\/mrff-withdraws-lawsuit\/\">Hall<\/a> atheist lawsuits. Eye&#8217;s other claim to fame is defending George Tiller&#8217;s <a href=\"https:\/\/prospect.org\/article\/news-flash-abortion-provider-wins-kansas\">abortionist associate<\/a>, Dr. Kris Neuhaus. It seems Mr. Eye could use either a little constitutional law refresher or an assistant to edit his missives.\u00a0 Maybe Chris Rodda could help.<\/p>\n<p>The issue of recruit religious support at RTC certainly warrants further attention and, most likely, a better resolution. But Weinstein&#8217;s opportunistic sensationalism does little more than reveal his own goals of publicity and fundraising, which benefits himself before military religious freedom. To wit, even Eye&#8217;s letter cites only the &#8220;rights&#8221; of a civilian volunteer &#8212; not the recruits.<\/p>\n<p>To this point, the Navy has said recruits will still have the ability to exercise their faiths. To this point &#8212; a month on from that decision &#8212; there are not (yet) any actual complaints from recruits themselves.
