{"id":30719,"date":"2014-12-30T00:45:38","date_gmt":"2014-12-30T03:45:38","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=30719"},"modified":"2016-11-25T00:49:46","modified_gmt":"2016-11-25T03:49:46","slug":"cair-sues-navy-over-religious-accommodation","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2014\/12\/30\/cair-sues-navy-over-religious-accommodation\/","title":{"rendered":"CAIR Sues Navy over Religious Accommodation"},"content":{"rendered":"<p><span style=\"color: #ff0000;\"><strong>Update<\/strong><\/span>: To answer one of the issues below, Berts has <a href=\"http:\/\/www.navytimes.com\/story\/military\/careers\/navy\/2015\/01\/08\/muslim-sailor-sues-to-re-join-active-duty-with-beard\/21388685\/\">now said<\/a><\/p>\n<blockquote><p>He had practiced Islam throughout his Navy career, Berts said in a Jan. 7 phone interview, but had become more observant by early 2011.<\/p>\n<p>&#8220;I celebrated Islamic holidays, I fasted during holidays, I prayed,&#8221; he said. &#8220;I started to get a deeper sense of faith and started to try to live my religion a bit more.&#8221;<\/p><\/blockquote>\n<hr \/>\n<p>The Council on American-Islamic Relations (CAIR) has filed a <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/bertscair.pdf\">lawsuit (PDF)<\/a> against the US Navy on behalf of Jon Berts, a former Sailor who was denied a request for a beard for his religious faith. Ordinarily, this might fall under the auspices of the other religious accommodation issues that have arisen this year, but there are several aspects of <a href=\"http:\/\/www.stripes.com\/news\/navy-discriminated-against-muslim-denied-promotion-over-beard-lawsuit-says-1.321274\">Berts&#8217; story<\/a> that are slightly unusual:<\/p>\n<blockquote><p>Jonathan Berts of Fairfield applied to wear a beard in January 2011, but Defense Department policy did not allow religious exemptions from grooming requirements&#8230;<\/p><\/blockquote>\n<p>First, the policy citation isn&#8217;t <em>entirely<\/em> true. It is true that <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/130017p.pdf\">DoDI 1300.17<\/a> (more <a href=\"http:\/\/www.christianfighterpilot.com\/religionandmilitary.htm\">here<\/a>) didn&#8217;t characterize grooming standards as &#8220;apparel,&#8221; but it was still possible to obtain a waiver for a beard &#8212; as other members of the military\u00a0did.<\/p>\n<p>Second, note the date: Berts was honorably discharged <!--more-->three years ago, so it seems a bit odd that he&#8217;s only filing a legal objection <em>now<\/em>. (The lawsuit doesn&#8217;t cite any ongoing grievance process in which he has been involved.)\u00a0 Further, he made his request\u00a0five years after his medical shaving waiver expired, and nine years after he&#8217;d enlisted. The lawsuit does not explain whether Berts was a recent convert or had a change in religious faith that altered his need for a beard &#8212; but <em>something<\/em> presumably changed.\u00a0 While not necessarily prejudicial, it is an odd unexplained fact that he made the request many years into his career.<\/p>\n<p>Also, a large portion of the lawsuit focuses on the &#8220;hostile work environment&#8221; created by superiors who used derogatory terms toward him after he made the request. While that may add fuel to a public relations fire, it isn&#8217;t really germane to\u00a0the US military&#8217;s policy on beards to which he seeks exception.<\/p>\n<p>The suit says\u00a0Berts&#8217; mistreatment &#8212; which allegedly includes reassignment and denial of promotion &#8212; began after his accommodation request, implying it was caused by his faith and request.\u00a0 At the same time, the suit indicates one superior &#8220;repeatedly questioned Plaintiff about his beard&#8230;&#8221; That wording may indicate Berts was <em>already<\/em> wearing a beard, despite the fact that military policies require troops to adhere to current policies until they obtain a waiver.<\/p>\n<p>If that is the case, reassignment and denial of promotion might have been required, not a sign of a &#8220;hostile work environment,&#8221; and would likely occur even today, despite the lawsuit&#8217;s attempt to say last <a href=\"http:\/\/christianfighterpilot.com\/blog\/2014\/01\/23\/us-military-publishes-new-religious-freedom-guidance\/\">January&#8217;s policy update<\/a> would have substantially affected Berts&#8217; status. (For a point of reference, a few months after the policy changes, the Army said only two requests were made for beards, and <a href=\"http:\/\/www.reuters.com\/article\/2014\/04\/28\/us-usa-army-religion-idUSBREA3R1F320140428\">both were denied<\/a>. An Air Force chaplain was <a href=\"http:\/\/christianfighterpilot.com\/blog\/2014\/09\/25\/us-air-force-enlists-first-bearded-rabbi\/\">permitted with a beard<\/a> later in the year.)<\/p>\n<p>Religious freedom should certainly be protected, and free exercise should be encouraged to the extent the mission allows.
