He did put a new twist on it this time, though, essentially saying the government <em>can<\/em> <a href=\"http:\/\/www.washingtontimes.com\/news\/2014\/oct\/1\/justice-antonin-scalia-defends-keeping-god-religio\/?page=all#pagebreak\">favor religion over non-religion<\/a>:<\/p>\n<blockquote><p>\u201cI think the main fight is to dissuade Americans from what the secularists are trying to persuade them to be true: that the separation of church and state means that the government cannot favor religion over nonreligion,\u201d Justice Scalia said.<\/p><\/blockquote>\n<p>There is nuance to that statement. Scalia had <!--more-->mentioned examples of the Pledge of Allegiance (&#8220;&#8230;one nation, <em>under God<\/em>&#8230;&#8221;) and municipal prayers that had been attacked in recent years &#8212; and continue to be so.\u00a0 Scalia says the government is allowed to have those expressions of religious belief.\u00a0 In essence, if those acts &#8220;favor&#8221; religion, as critics assert, then Scalia says the government can favor religion:<\/p>\n<blockquote><p>Justice Scalia said that even President Thomas Jefferson, who\u2019s credited with creating the concept of separation of church and state, wrote in the Virginia Declaration of Religious Freedom that, \u201cGod who made the mind of man made it free.\u201d<\/p>\n<p>\u201cWe do him [God] honor in our pledge of allegiance, in all our public ceremonies,\u201d Justice Scalia said. \u201cThere\u2019s nothing wrong with that. It is in the best of American traditions, and don\u2019t let anybody tell you otherwise. I think we have to fight that tendency of the secularists to impose it on all of us through the Constitution.\u201d<\/p><\/blockquote>\n<p>The focus, then, isn&#8217;t on the government <em>promoting<\/em> religion. The focus is permitting religious exercise even in public &#8212; something <em>secularists<\/em> call &#8220;favoring&#8221; religion.<\/p>\n<p>Critics of religious liberty like Michael &#8220;Mikey&#8221; Weinstein have made similar accusations against the US military, claiming that allowing public expression &#8220;favors&#8221; religion or otherwise undermines the military mission.\u00a0 And as Scalia noted secularists trying to bludgeon religion with the US Constitution, so, too, Weinstein uses the Constitution and military regulations as clubs in his attempts to beat religious liberty out of the US military.<\/p>\n<p>Will Scalia&#8217;s defense of the Constitution prevail?\u00a0 Will Weinstein?\u00a0 It remains to be seen.<\/p>\n<div class=\"fb-like\" data-share=\"true\" data-show-faces=\"true\" data-size=\"small\" data-action=\"like\" data-layout=\"standard\"><\/div>\n<p><span style=\"font-size: xx-small;\"><strong>ADVERTISEMENT<\/strong><\/span><\/p>\n<hr \/>\n<p><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js\"><\/script><!-- blogpost --><ins class=\"adsbygoogle\" style=\"display: block;\" data-ad-format=\"auto\" data-ad-slot=\"2728423835\" data-ad-client=\"ca-pub-6450825356098669\"><\/ins><script>\n(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/p>\n<hr \/>\n","protected":false},"excerpt":{"rendered":"<p>This isn&#8217;t actually news: Justice Antonin Scalia has long said nothing in the US Constitution requires the government to scrub all appearances of religion from the public square.
