{"id":29875,"date":"2014-09-12T00:15:37","date_gmt":"2014-09-12T03:15:37","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=29875"},"modified":"2016-11-25T01:14:54","modified_gmt":"2016-11-25T04:14:54","slug":"air-force-seeks-dod-review-of-oath","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2014\/09\/12\/air-force-seeks-dod-review-of-oath\/","title":{"rendered":"Air Force Seeks DoD Review of Oath"},"content":{"rendered":"<p><span style=\"color: #ff0000;\"><strong>Update<\/strong><\/span>: Patrick Vaughn, general counsel for the American Family Association, <a href=\"http:\/\/www.onenewsnow.com\/perspectives\/miscellaneous\/2014\/09\/12\/air-force-cant-use-oath-to-disqualify-atheist-sergeant\">wrote an article<\/a> saying &#8220;The U.S. Constitution makes it clear: American atheists are not and should not be barred from serving their country through military service.&#8221;<\/p>\n<hr \/>\n<p>Facing scrutiny for its letter-of-the-law requirement that Airmen <a href=\"http:\/\/christianfighterpilot.com\/blog\/2014\/09\/08\/air-force-oath-atheists-protest-right-thing-the-wrong-way\/\">enlist with &#8220;So help me God,&#8221; <\/a>the Air Force has asked the DoD General Counsel to <a href=\"http:\/\/www.stripes.com\/news\/us\/air-force-seeks-dod-ruling-on-re-enlistment-oath-1.302225\">provide an official legal opinion<\/a>:<\/p>\n<blockquote><p>The Air Force said Tuesday it was awaiting a legal opinion from the Defense Department\u2019s top lawyer on whether an enlisted airman who\u2019s an atheist can opt out of the phrase \u201cso help me God\u201d in his re-enlistment oath&#8230;<\/p>\n<p>\u201cThe opinion that we\u2019re seeking will help inform future decisions and the latitude that can be taken with the oath,\u201d Air Force spokeswoman Rose Richeson said Tuesday. \u201cBut the Air Force has to comply with law.\u201d<\/p><\/blockquote>\n<p>From an objective position, <!--more-->that does not seem to be an\u00a0unreasonable course of action. The US military cannot make law; it can only follow the law. Where there may be disagreement with its position, it can certainly ask its superiors for guidance &#8212; guidance that will remove any appearance of <em>subjectivity<\/em> on its own part.<\/p>\n<p>Many have already provided legal opinions that the law doesn&#8217;t say what it seems to say. One of the more compelling explanations is that <a href=\"http:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2014\/09\/08\/should-atheists-who-refuse-to-say-so-help-me-god-be-excluded-from-the-air-force\/\">of Eugene Volokh<\/a>, as he cites the law and then explains it using court cases citing Black&#8217;s Law Dictionary:<\/p>\n<blockquote><p>Given this context, it seems to me quite clear that \u201cSo help me God\u201d in the statute should be read as an optional component&#8230;<\/p><\/blockquote>\n<p>That&#8217;s fair, but as the Air Force has learned recently, what is &#8220;quite clear&#8221; to one person may be entirely unclear to another. It is surprisingly common to request legal written opinions on certain matters in the military to provide a commander with guidance.\u00a0 Those legal opinions are precisely that &#8212; <em>opinions<\/em>.\u00a0 For a service that has been berated for its legal opinions recently, it shouldn&#8217;t seem unreasonable that it would seek higher level direction to re-enact what some people viewed as a deviation from the law.<\/p>\n<p>Volokh also takes former US Rep &#8212; and retired Army LtCol &#8212; Allen West to task for supporting the &#8220;new&#8221; Air Force policy. <a href=\"http:\/\/allenbwest.com\/2014\/09\/hallelujah-god-reenlists-air-force\/\">West said<\/a>:<\/p>\n<blockquote><p>Service in the United States military is voluntary and its members take an oath to support and defend the United States Constitution. That being the case, to whom should an oath or a pledge be rendered? That would be my question.<\/p><\/blockquote>\n<p>To be fair, oaths <em>have<\/em> been under secularist attack, and the vitriol leveled against the US Air Force Academy <a href=\"http:\/\/christianfighterpilot.com\/blog\/2013\/10\/28\/usafa-says-so-help-me-god-is-optional\/\">last fall by critic Mikey Weinstein<\/a> was part of the context of West&#8217;s outrage. USAFA eventually said it changed its cadet honor oath to make &#8220;so help me God&#8221; optional in response to Weinstein&#8217;s criticisms &#8212; failing to note it was <em>always<\/em> optional, and failing to come up with a coherent way to even deliver the oath in the future (saying the person leading the 4,000 strong cadet wing might, or might not, include the phrase).<\/p>\n<p>Thus, West&#8217;s article is written as a &#8220;hallelujah&#8221; that secularists are being rebuffed in their attacks on all things religion in the US military, as he further cites the US Navy&#8217;s <a href=\"http:\/\/christianfighterpilot.com\/blog\/2014\/08\/14\/navy-bans-bibles-after-atheist-complaint\/\">reversal of its removal of Bibles<\/a> from Navy Lodges. But the oath <em>isn&#8217;t<\/em> an example of secularism run amok. In this case, no one is demanding\u00a0the phrase be banned as an endorsement of religion, for example. They only want a person who does not ascribe to a deity to be able to deviate from the apparent requirement to swear to one.<\/p>\n<p>That&#8217;s religious freedom.<\/p>\n<p>Bryan Fischer of the American Family Association &#8212; who previously said <a href=\"http:\/\/christianfighterpilot.com\/blog\/2009\/11\/10\/religion-in-the-military-endures-scrutiny-after-fort-hood\/\">Muslims shouldn&#8217;t serve in the military<\/a> unless they can prove their loyalty &#8212; has taken the Air Force&#8217;s position to a further extreme, declaring <a href=\"http:\/\/www.onenewsnow.com\/perspectives\/bryan-fischer\/2014\/09\/10\/no-atheist-should-be-permitted-to-serve-in-the-us-military\">atheists shouldn&#8217;t serve in the US military<\/a>:<\/p>\n<blockquote><p>There is no place in the United States military for those who do not believe in the Creator who is the source of every single one of our fundamental human and civil rights.<\/p>\n<p>Serving in the military is a privilege, not a constitutional right. And it should be reserved for those who have America&#8217;s values engraved on their hearts.<\/p><\/blockquote>\n<p>That&#8217;s an asinine position. The US Constitution protects the government from interfering or discriminating against citizens&#8217; religious liberty.
