{"id":29248,"date":"2014-06-24T01:00:53","date_gmt":"2014-06-24T04:00:53","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=29248"},"modified":"2016-11-25T22:43:15","modified_gmt":"2016-11-26T01:43:15","slug":"mikey-weinstein-claims-victory-in-lawsuit","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2014\/06\/24\/mikey-weinstein-claims-victory-in-lawsuit\/","title":{"rendered":"Mikey Weinstein Claims Victory in Lawsuit"},"content":{"rendered":"<p>Michael &#8220;Mikey&#8221; Weinstein recently claimed victory in a lawsuit &#8212; which is no small thing for a man who has lost <a href=\"http:\/\/christianfighterpilot.com\/blog\/2012\/04\/04\/michael-weinstein-loses-lawsuit-against-imprecatory-chaplain\/\">5 of the past 5 lawsuits he&#8217;s filed<\/a> over the past decade in his attacks on military religious freedom. The announcement, though, was subtle.<\/p>\n<p>One of Weinstein&#8217;s favorite media advocates, local journalist Pam Zubeck, included a nearly irrelevant reference to Weinstein in an <a href=\"http:\/\/www.csindy.com\/coloradosprings\/soldiers-advocates-take-to-court-to-fight-carson-ban\/Content?oid=2872262\">article about Fort Carson<\/a>:<\/p>\n<blockquote><p>Mikey Weinstein leads the Military Religious Freedom Foundation, <strong>which won a settlement in a lawsuit<\/strong> against the Air Force Academy superintendent on behalf of a former employee.<\/p><\/blockquote>\n<p>Weinstein&#8217;s ego knows no bounds, so it is significant that this <!--more-->is the first time the MRFF has publicly acknowledged &#8216;winning a lawsuit&#8217; (against the US Air Force Academy, no less), and that it would do so without pomp and circumstance.<\/p>\n<p>Unless, of course, not talking about it was part of the settlement.<\/p>\n<p>Given the circumstances, Weinstein is almost certainly referring to <em>Mullin v Donley<\/em>, which may technically be a lawsuit but may be better understood as an administrative EEO complaint.<\/p>\n<p>Former US Air Force Academy instructor R. David Mullin (who <a href=\"http:\/\/christianfighterpilot.com\/blog\/2011\/02\/10\/usafa-lawsuit-dismissed-weinstein-goes-0-for-4\/\">famously sued<\/a> to <a href=\"http:\/\/christianfighterpilot.com\/blog\/2011\/02\/01\/mrff-sues-usafa-over-mcclary-invitation\/\">stop retired Lt Clebe McClary<\/a> from speaking at USAFA&#8217;s National Prayer Lunceon), filed an EEO complaint because his supervisor told him he needed to get up and walk around to monitor cadets&#8217; use of their laptops. Mullin said his employment agreement allowed him to teach sitting down because he has &#8220;limbically augmented pain syndrome.&#8221;<\/p>\n<p>Given that his supervisor acknowledged he did tell Mullin that, so long as that was part of the employment agreement, it shouldn&#8217;t have been a tough case to win.
