{"id":28529,"date":"2014-03-12T17:50:44","date_gmt":"2014-03-12T20:50:44","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=28529"},"modified":"2016-09-26T12:10:38","modified_gmt":"2016-09-26T15:10:38","slug":"update-mikey-weinstein-threatens-suit-if-usafa-cadets-not-punished","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2014\/03\/12\/update-mikey-weinstein-threatens-suit-if-usafa-cadets-not-punished\/","title":{"rendered":"Update: Mikey Weinstein Threatens Suit if USAFA Cadets Not Punished"},"content":{"rendered":"<p>Michael &#8220;Mikey&#8221; Weinstein, a self-described religious liberty advocate, is threatening to sue the US Air Force Academy if it fails to punish cadets who exercised their religious liberty.<\/p>\n<p>As <a href=\"http:\/\/christianfighterpilot.com\/blog\/2014\/03\/12\/usafa-defends-cadets-against-mikey-weinstein-sort-of\/\">previously noted<\/a> in the original discussion, a large group of cadets responded to the original story of Weinstein successfully getting a Bible verse erased from a cadet whiteboard by posting verses of their own &#8212; from the Bible, Qur&#8217;an, movies, the Helix, and even the Flying Spaghetti Monster. (One said &#8220;go atheists!&#8221;)<\/p>\n<p>According to an <a href=\"http:\/\/www.theblaze.com\/stories\/2014\/03\/12\/some-air-force-cadets-so-angry-over-what-happened-with-bible-verses-on-campus-they-have-staged-a-revolt\/\">update at TheBlaze<\/a>, Weinstein wants everyone who posted <em>verses<\/em> punished, for some reason, though he didn&#8217;t mention <!--more-->those that posted non-religious text [emphasis added]:<\/p>\n<blockquote><p>\u201cThe Air Force Academy has a revolt on their hands. What are they going to do?\u201d Weinstein told TheBlaze Wednesday&#8230;<\/p>\n<p>Weinstein said <strong>posting verses outside a bedroom door is unacceptable and illegal<\/strong> because that\u2019s part of the \u201cworking squadron area\u201d \u2014 a central and public location where cadets assemble.<\/p><\/blockquote>\n<p>While Weinstein is free to think that, it doesn&#8217;t make it true, and the Academy &#8212; which has the authority to decide what is or is not a &#8220;working squadron area&#8221; &#8212; has disagreed to this point. Also, the distinction between religious and non-religious text is important.\u00a0 As the FRC and Liberty Institute have noted, if USAFA allows personal quotes and the like, then they cannot prohibit religious text.\u00a0 Still, Weinstein wants the cadets&#8217; heads [emphasis added]:<\/p>\n<blockquote><p>Weinstein is now calling on the Air Force Academy to take action against those individuals <strong>who are posting scripture messages <\/strong>outside their doors&#8230;<\/p>\n<p>Weinstein said those who put Bible verses on their doors <strong>deserve \u201cnon-judicial punishment<\/strong> at the very least&#8230;\u201d<\/p>\n<p>Weinstein is willing to <strong>take the Air Force Academy to court<\/strong> if the issue isn\u2019t resolved.<\/p><\/blockquote>\n<p>Not unlike <a href=\"http:\/\/christianfighterpilot.com\/blog\/2013\/08\/14\/breaking-air-force-restores-censored-chaplain-article\/\">the Alaskan Chaplain article<\/a> from a few months ago, <a href=\"http:\/\/www.prnewswire.com\/news-releases\/liberty-institute-outraged-by-air-force-academy-decision-to-erase-cadets-bible-verse-249744391.html\">the Liberty Institute says<\/a> the Air Force Academy may have actually <em>violated<\/em> the law in taking the verse down:<\/p>\n<blockquote><p>Berry said the removal of the Bible verse and any punishment is actually a violation of the Department of Defense Instruction 1300.17, a provision that protects soldiers\u2019 religious liberty.<\/p>\n<p>\u201cUnless it could have an adverse impact on military readiness, unit cohesion, and good order and discipline, the Military Departments will accommodate individual expressions of sincerely held beliefs [&#8230;] of Service members in accordance with the policies and procedures in this instruction&#8230;,\u201d the provision states in part.<\/p><\/blockquote>\n<p>USAFA did not say they ordered the verse erased, though that is certainly the perception being generated in public.<\/p>\n<p>One subtle point missed by most people has been an &#8220;addendum&#8221; in Weinstein&#8217;s latest volley.\u00a0 Weinstein provided TheBlaze with an email he likely solicited or coached from one of his acolytes [emphasis added]:<\/p>\n<blockquote><p>Theses [<em>sic<\/em>] posts, quotes, and comments <strong>on social media<\/strong> have created a hostile environment and have lead to a decrease in unit cohesion and morale and are unprofessional in the military environment&#8230;<\/p><\/blockquote>\n<p>The reason Weinstein&#8217;s cadet cited the &#8220;hostile environment&#8221; and &#8220;morale&#8221; is those key words would technically allow the Air Force to prohibit otherwise permissible conduct.\u00a0 More importantly, note the cadet didn&#8217;t just say the verses in the hallways, but the ones &#8220;<strong>on social media<\/strong>.&#8221;\u00a0 Would Weinstein <em>really<\/em> assert that cadets or military officers who put verses on social media be punished as &#8220;unprofessional&#8221;?<\/p>\n<p>Yes, he would.<\/p>\n<p>How USAFA responds will be interesting.<\/p>\n<p>A clear, firm, and decisive response eliminates ambiguity in the public and helps cadets know where their\u00a0leadership stands.\u00a0 Anything short of that simply extends the &#8220;controversy.&#8221;<\/p>\n<p>To this point, they&#8217;ve said only that the decisions were made by cadets, while acknowledging that cadets live and work in the same space:<\/p>\n<blockquote><p>We [USAFA] didn\u2019t take them down. When this was identified through the chain of comment [<em>sic<\/em>], they had a discussion, and the discussion went to cadets about what the best way forward would be. The decision to take it down was this cadet who lived in this room was in a leadership position. Because of that, they determined is the perception of some that if I\u2019m going to speak to that cadet, the entry fee, if you will, to get into the office is to abide by that statement?<\/p>\n<p>It would have been better not to have been in a publicly placed area. If you\u2019re in a leadership position you can\u2019t have something that would potentially imply if you have a certain belief, you can\u2019t come see me.<\/p>\n<p>Their office is also their home.
