{"id":25983,"date":"2013-10-15T00:45:10","date_gmt":"2013-10-15T03:45:10","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=25983"},"modified":"2016-11-26T00:36:25","modified_gmt":"2016-11-26T03:36:25","slug":"air-force-investigation-finds-no-religious-discrimination","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2013\/10\/15\/air-force-investigation-finds-no-religious-discrimination\/","title":{"rendered":"Air Force Investigation Finds No Religious Discrimination"},"content":{"rendered":"<p>An Air Force investigation was initiated after SMSgt Philip Monk filed a complaint of religious discrimination, claiming he was relieved and reassigned earlier than planned after a conversation with his commanding officer, Maj Elisa Valenzuela.\u00a0 The Air Force issued a <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/monkrelease.pdf\">press release<\/a> about the investigation, saying the charges of religious discrimination <a href=\"http:\/\/www.airforcetimes.com\/article\/20131011\/NEWS\/310110013\">were not substantiated<\/a>:<\/p>\n<blockquote><p>The investigation, initiated Aug. 15 by Col. Mark Camerer, 37th Training Wing commander at Joint Base San Antonio-Lackland, found the claim unsubstantiated&#8230;<\/p>\n<p>\u201cThe weight of the evidence shows that religion was never discussed between the two,\u201d Camerer said in an Air Education and Training Command release.<\/p>\n<p>\u201cIn the end, this is a case about command authority, good order and discipline, and civil rights \u2014 not religious freedoms,\u201d he said.<\/p><\/blockquote>\n<p>Interestingly, no one ever publicly\u00a0claimed &#8220;religion was&#8230;discussed between the two,&#8221; but it raises the question as to whether one must\u00a0explicitly <em>voice<\/em> a religious belief for it to be actionable.\u00a0 The investigation also made an interesting comment about the\u00a0statements at the heart of the controversy\u00a0[emphasis added]:\u00a0 <!--more--><\/p>\n<blockquote><p>\u201cBased on his training as a first sergeant, Senior Master Sgt. Monk should have known that <strong>discriminatory remarks on the basis of sexual orientation<\/strong> are against Air Force Policy.<\/p><\/blockquote>\n<p>The statement seems odd, because Monk\u00a0is not alleged to have made any such remarks, nor has his conduct with regard to such remarks been brought into question.\u00a0 Another <a href=\"http:\/\/www.stripes.com\/news\/air-force\/af-says-airman-s-discrimination-claim-unfounded-1.246295\">statement from Lackland<\/a> used similar language:<\/p>\n<blockquote><p>\u201cThis incident was never about religious freedom, but about command authority and civil rights,\u201d Lt. Col. Sean McKenna, an Air Education and Training Command spokesman, said in an email. \u201cIt was handled appropriately, with <strong>a commander counseling a military training instructor for comments deemed discriminatory in nature<\/strong>.<\/p><\/blockquote>\n<p>What\u00a0comments did the Air Force declare\u00a0&#8220;discriminatory&#8221;?\u00a0 Here&#8217;s a reminder of what <a href=\"http:\/\/radio.foxnews.com\/toddstarnes\/top-stories\/airmen-punished-for-objecting-to-gay-marriage.html\"><em>allegedly<\/em> transpired<\/a>\u00a0(since no public information on what <em>actually<\/em> transpired has been released):<\/p>\n<blockquote><p>Monk said&#8230;the instructor[&#8216;s] public comments compar[ed] the United States with the fall of the Roman Empire.<\/p>\n<p>\u201cHe said in spite of our differences, we can\u2019t let that happen to the United States,\u201d Monk said. \u201cHe then used homosexual marriage as an example \u2013 saying that <strong>he didn\u2019t believe in it \u2013 but it doesn\u2019t matter<\/strong> because he was going to train them the same way.\u201d<\/p><\/blockquote>\n<p>The Air Force reportedly called those words &#8220;discriminatory.&#8221;<\/p>\n<p>The release also said the Air Force was &#8220;no longer&#8221; charging Monk\u00a0with making false <em>official <\/em>statements &#8212; though the investigator concluded <a href=\"http:\/\/www.stripes.com\/news\/air-force\/af-says-airman-s-discrimination-claim-unfounded-1.246295\">Monk <em>did<\/em> make false <em>statements<\/em><\/a>. Though not explicit, it seems Monk was investigated for remarks he made to the press about his relief and reassignment, but because they were not <em>official<\/em> statements, the investigation determined he did not violate the UCMJ.\u00a0 Even so, the UCMJ specifically says that a belief that something is true &#8212; even if &#8220;erroneous&#8221; &#8212; is a defense, and Monk clearly believed his characterization of his reassignment was accurate.<\/p>\n<p>The investigator continued:<\/p>\n<blockquote><p>[Monk] should have also known, while Air Force members do have the right to speech and religion, that right does not mean airmen can say whatever they want, whenever they want.<\/p><\/blockquote>\n<p>It&#8217;s difficult to analyze the comment without context, as the Air Force reportedly <a href=\"http:\/\/www.mysanantonio.com\/news\/religion\/article\/AF-says-airman-s-discrimination-claim-unfounded-4882867.php\">declined to release the report<\/a> but did include that statement in the press release.\u00a0 In isolation, the comment seems like a straw man: Publicly, neither Monk nor the Airman claimed a right to &#8220;say whatever they want, whenever they want.&#8221;\u00a0 The were only two conversations in question &#8212; one between the Airman and trainees, the other between Monk and his commander &#8212; and both were in\u00a0specific,\u00a0legitimate contexts.\u00a0 Why the Air Force scolded Monk on the irrelevant issue of &#8220;whatever, whenever&#8221; is unclear.<\/p>\n<p>In the end, the report said only that Monk&#8217;s claims of religious discrimination were &#8220;unsubstantiated.&#8221;\u00a0 Michael Weinstein &#8212; who took the unprecedented step of accepting an Air Force investigation at face value &#8212; took a more proactive view of the report,\u00a0<a href=\"https:\/\/www.facebook.com\/photo.php?fbid=10151998288118410&amp;set=a.460049233409.265966.7515233409&amp;type=1\">reading into it that the Air Force<\/a><\/p>\n<blockquote><p>debunked [SMSgt Monk] as an anti-gay bigot<\/p><\/blockquote>\n<p>So, in Weinstein&#8217;s world, <em>not<\/em> being the victim of religious discrimination makes one a bigot? Weinstein seems to have forgotten that some of his own &#8220;clients&#8221; have made claims that were &#8220;unsubstantiated.&#8221;<\/p>\n<p>(As an aside, Weinstein continued his <a href=\"http:\/\/christianfighterpilot.com\/blog\/2010\/03\/05\/weinstein-defines-religions-assigns-followers\/\">tradition of assigning religious labels<\/a>, saying Monk was &#8220;the poster-child of the fundamentalist Christian Dominionist lobby.&#8221;\u00a0 Weinstein provided no evidence to support his claim he knew\u00a0Monk&#8217;s religious beliefs.)<\/p>\n<p>There is no question Monk&#8217;s new <a href=\"http:\/\/www.bpnews.net\/bpnews.asp?id=41281\">assignment was moved up<\/a> after the conversation with his commander, as Monk asserted &#8212; though to <a href=\"http:\/\/www.onenewsnow.com\/legal-courts\/2013\/10\/15\/religious-freedom-case-\u2013-did-air-force-alter-nco\u2019s-papers\">imply they were &#8220;altered&#8221;<\/a> is probably not the right wording.\u00a0 (The <a href=\"http:\/\/www.libertyinstitute.org\/u.s.-air-force-officially-accused-smsgt-phillip-monk-of-lying\">second set of orders<\/a> was even signed the day immediately prior to the new effective date and immediately upon the arrival of Monk&#8217;s replacement, which was not the briefed plan.)
