{"id":21418,"date":"2013-02-12T02:18:40","date_gmt":"2013-02-12T05:18:40","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=21418"},"modified":"2016-11-26T01:52:08","modified_gmt":"2016-11-26T04:52:08","slug":"weinstein-threatens-us-military-with-another-lawsuit","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2013\/02\/12\/weinstein-threatens-us-military-with-another-lawsuit\/","title":{"rendered":"Weinstein Threatens US Military with Another Lawsuit"},"content":{"rendered":"<p>In October of last year, an atheist Army Soldier, SSgt Victoria Gettman, <a href=\"http:\/\/www.huffingtonpost.com\/2012\/10\/02\/military-proselytizing-army-chaplain_n_1930703.html\">lodged complaints<\/a> after a mandatory suicide prevention briefing ended with a military chaplain taking the stage and offering a candlelit prayer.<\/p>\n<p>The incident seems fairly benign, and merited little attention at the time.\u00a0 Now, though, it seems Michael Weinstein is weighing in with (<a href=\"http:\/\/christianfighterpilot.com\/blog\/2013\/02\/11\/weinstein-threatens-us-military-with-yet-another-lawsuit\/\">yet another<\/a> empty) <a href=\"http:\/\/www.huffingtonpost.com\/2013\/02\/08\/army-religious-freedom-lawsuit_n_2646086.html\">promise to file a lawsuit<\/a>:<\/p>\n<blockquote><p>Mikey Weinstein, founder of the Military Religious Freedom Foundation, doesn&#8217;t consider Gettman&#8217;s case closed, and he and his litigation team intend to pursue an &#8220;aggressive&#8221; federal lawsuit if the Army fails to rectify Gettman&#8217;s complaints.<\/p><\/blockquote>\n<p>The article contains an important quote from Gettman [emphasis added]:\u00a0 <!--more--><\/p>\n<blockquote><p>[Gettman] now feels that she has <strong>exhausted all of her options<\/strong>. &#8220;I&#8217;m so frustrated, I&#8217;m so aggravated,&#8221; Gettman said. &#8220;I just don&#8217;t know what to do.&#8221;<\/p><\/blockquote>\n<p>&#8220;Exhausted all&#8230;options&#8221; is important code for\u00a0Weinstein, as it moves him beyond the Motion to Dismiss that has doomed his other public relations &#8212; er, &#8220;legal&#8221; &#8212; efforts on behalf of other enlisted troops\u00a0(troops Weinstein has\u00a0since discarded).\u00a0 The judicial branch has a history of granting deference to the military and has historically only taken cases when servicemembers &#8220;exhaust&#8221; the internal remedies afforded by the military complaint systems.<\/p>\n<p>Importantly, though, while Gettman may &#8220;feel&#8221; that way, the article seems to tell a different story [emphasis added]:<\/p>\n<blockquote><p>Gettman filed written complaints <strong>both <\/strong>to the Army&#8217;s <strong>Inspector General <\/strong>and her base&#8217;s <strong>equal opportunity office<\/strong>, charging&#8230;<\/p><\/blockquote>\n<p>Gettman filed complaints in <em>two <\/em>systems &#8212; yet the article only covers one, the Equal Opportunity office.\u00a0 Further:<\/p>\n<blockquote><p>[Gettman] went to her first-line [EO officer] for information. She said she was then contacted by a different EOA, who told her the case had been ruled unsubstantiated&#8230;<\/p><\/blockquote>\n<p>The article does not say Gettman has sought any kind of appeal.\u00a0 According to the only public information available, SSgt Gettman filed <em>two <\/em>complaints, got one <em>initial <\/em>response, and thinks she&#8217;s done.\u00a0 She&#8217;s wrong.\u00a0 Despite the fact she&#8217;s been in the military for 17 years, it seems she needs to be educated on how the military works.<\/p>\n<p>More to the point, it seems she and Weinstein aren&#8217;t interested in her complaint being <em>addressed <\/em>&#8212; they have both indicated <a href=\"http:\/\/christiannews.net\/2013\/02\/09\/united-states-army-threatened-with-lawsuit-over-chaplains-prayer-to-heavenly-father\/\">they expect a specific <em>resolution<\/em><\/a>.<\/p>\n<blockquote><p>Gettman has not been <strong>satisfied with the response <\/strong>she has received&#8230;[Weinstein] was <strong>unhappy with the response <\/strong>he received as well.<\/p><\/blockquote>\n<p>Thus, it isn&#8217;t that the military is <em>mistreating <\/em>Gettman or her complaint &#8212; it&#8217;s that the outcome\u00a0isn&#8217;t what they <em>want<\/em>.<\/p>\n<p>The simple fact remains there is nothing wrong with a chaplain leading a prayer in front of a military formation.\u00a0 Critics may bristle at a public display of religiosity, but the fact they bristle at a mere <em>display <\/em>of religiosity says more about <em>them <\/em>than it does about the US military.<\/p>\n<p>For the time being, the US military has declined to scrub itself of vestiges of the faith of its troops.\u00a0 The expression of faith and the acceptance of those who espouse faith are still valued &#8212; even protected &#8212; by the US Constitution and the US military.<\/p>\n<div class=\"fb-like\" data-share=\"true\" data-show-faces=\"true\" data-size=\"small\" data-action=\"like\" data-layout=\"standard\"><\/div>\n<p><span style=\"font-size: xx-small;\"><strong>ADVERTISEMENT<\/strong><\/span><\/p>\n<hr \/>\n<p><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js\"><\/script><!-- blogpost --><ins class=\"adsbygoogle\" style=\"display: block;\" data-ad-format=\"auto\" data-ad-slot=\"2728423835\" data-ad-client=\"ca-pub-6450825356098669\"><\/ins><script>\n(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/p>\n<hr \/>\n","protected":false},"excerpt":{"rendered":"<p>In October of last year, an atheist Army Soldier, SSgt Victoria Gettman, lodged complaints after a mandatory suicide prevention briefing ended with a military chaplain taking the stage and offering a candlelit prayer.
