{"id":207,"date":"2008-07-09T05:11:05","date_gmt":"2008-07-09T09:11:05","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=207"},"modified":"2015-06-27T19:16:57","modified_gmt":"2015-06-27T22:16:57","slug":"govt-moves-to-dismiss-mrff-lawsuit","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2008\/07\/09\/govt-moves-to-dismiss-mrff-lawsuit\/","title":{"rendered":"Government Moves to Dismiss MRFF Lawsuit"},"content":{"rendered":"<p>In a fairly well written argument, the government has filed a <a href=\"http:\/\/christianfighterpilot.com\/articles\/files\/dismissmemo.pdf\">motion to dismiss<\/a> the ongoing lawsuit against the Defense Department brought by Army Specialist Jeremy Hall and the Military Religious Freedom Foundation.\u00a0 (The response was due, and filed, on the 8th.)\u00a0 Salient points are below (emphasis added),\u00a0though many were previously already talked about <a href=\"http:\/\/christianfighterpilot.com\/blog\/?p=126\">here<\/a>.<\/p>\n<p>The short version:\u00a0he failed to use the systems in place to seek redress; the solutions he requests are already in place; and he does not allege harm by any &#8220;institutional bias&#8221; for which the only support is\u00a0a list of vague references.<\/p>\n<p>On the request that Secretary of Defense Gates be required to prevent Constitutional violations by his military subordinates:<\/p>\n<blockquote><p>Secretary Gates <em><strong>already exercises<\/strong><\/em> his authority to prevent constitutional violations through the Army\u2019s <em><strong>existing<\/strong><\/em> Equal Opportunity Program \u2014 which Specialist Hall failed to invoke&#8230;<\/p><\/blockquote>\n<p><!--more--><\/p>\n<p>Regarding the &#8220;injury&#8221; that the Plaintiffs would like redressed:\u00a0<\/p>\n<blockquote><p>Plaintiffs lack standing to challenge the purported \u201cpattern and practice\u201d of impermissible support of religion within the Department of Defense because <strong><em>they fail to establish that Specialist Hall<\/em> \u2014 or <em>anyone else<\/em><\/strong> \u2014 has been personally injured by those alleged practices.<\/p><\/blockquote>\n<p>On his failure to\u00a0use the in-place systems, a\u00a0precedent:\u00a0<\/p>\n<blockquote><p>Specialist Hall\u2019s claims are barred under the Mindes doctrine because <em><strong>he failed to exhaust his intramilitary remedies<\/strong><\/em>.<\/p><\/blockquote>\n<p>Referring to the history of the courts&#8217; reluctance\u00a0to\u00a0review military processes:\u00a0<\/p>\n<blockquote><p>[J]udicial review would <em><strong>significantly interfere with military operations<\/strong><\/em> and intrude on sensitive disciplinary and personnel matters committed to military expertise.<\/p><\/blockquote>\n<p>On the addition to the suit that alleged he had been denied promotion:<\/p>\n<blockquote><p>[L]ike the plaintiff in <em>Gonzalez<\/em>, Specialist Hall <em><strong>remains eligible for promotion<\/strong><\/em>,\u00a0and future promotion decisions can be challenged via intramilitary channels. In fact, the decision at issue [his alleged denial of promotion] here is <em><strong>still reviewable<\/strong><\/em> by the [Board for Corrections of Military Records].\u00a0<\/p><\/blockquote>\n<p>Amusingly, the government addressed the co-plaintiff (the MRFF) only once,\u00a0when they dismissed them\u00a0out of hand&#8211;in a footnote:<\/p>\n<blockquote><p>The [MRFF] has no greater standing than does Specialist Hall.
