The 9th Circuit court of appeals previously ruled the 43-foot cross unconstitutional.<\/p>\n<blockquote><p>The government should not be required &#8220;to tear down a cross that has stood without incident for 58 years as a highly venerated memorial to the nation\u2019s fallen service members,&#8221; Solicitor General <!--more-->Donald Verrilli Jr. said in a new appeal to the high court.<\/p><\/blockquote>\n<p>The article notes the Supreme Court <a href=\"http:\/\/christianfighterpilot.com\/blog\/2010\/04\/29\/supreme-court-reverses-injunction-against-mojave-cross\/\">supported the display of the Mojave cross<\/a> two years ago, which overturned <em>another <\/em>9th Circuit ruling, and which\u00a0the 9th Circuit &#8220;ignored&#8221; in this case.\u00a0 Notably, the <a href=\"http:\/\/christianfighterpilot.com\/blog\/2010\/05\/21\/latest-mojave-cross-mysteries\/\">Mojave cross was stolen<\/a> and still hasn&#8217;t been replaced, and a <a href=\"http:\/\/christianfighterpilot.com\/blog\/2011\/01\/17\/obama-administration-sued-for-not-transferring-land-cross\/\">lawsuit has been filed<\/a> to force the government to adhere to the SCOTUS ruling.<\/p>\n<p>The Soledad case is now known as <em>US v Trunk<\/em>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Obama&#8217;s Justice Department is reportedly appealing the case of the Mount Soledad Memorial to the US Supreme Court.\u00a0 (A similar petition was filed by the Liberty Institute.)
