{"id":14362,"date":"2012-01-03T01:00:15","date_gmt":"2012-01-03T04:00:15","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=14362"},"modified":"2013-10-27T23:01:41","modified_gmt":"2013-10-28T02:01:41","slug":"canadian-court-rules-against-multiple-marriages","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2012\/01\/03\/canadian-court-rules-against-multiple-marriages\/","title":{"rendered":"Canadian Court Rules Against Multiple Marriages"},"content":{"rendered":"<p>While Canada&#8217;s acceptance of homosexuality was occasionally held up as a contrast to their southern cousins in the United States, it seems Canada hasn&#8217;t worked out all the moral issues associated with &#8220;sexual freedom,&#8221; either.<\/p>\n<p>In late November British Columbia&#8217;s superior trial court <a href=\"http:\/\/www.adfmedia.org\/News\/PRDetail\/5211\">upheld Canada&#8217;s law banning polygamy and polyamory<\/a>.<\/p>\n<p>Interestingly, the court found that such prohibitions <em>did <\/em>violate the religious liberty of some groups &#8212; including some Mormons, Muslims, and Wiccans &#8212; but the law <!--more-->was consistent with &#8220;reasonable limits&#8230;justified in a free and democratic society.&#8221;<\/p>\n<p>A lawyer for the FLDS noted a simple workaround: So long as they didn&#8217;t get &#8220;married&#8221; in an event sanctioned by the state, they were legal.<\/p>\n<p>While one would think homosexual advocates would come to the defense of polygamists\/polyamorists&#8217; &#8220;sexual rights,&#8221; they generally haven&#8217;t. Instead, participants of multiple marriage have had to &#8220;lie about who they are&#8221; and are judged because of &#8220;who they love,&#8221; or more specifically, &#8220;how many people they love.&#8221;<\/p>\n<p>Many, though not all, homosexual advocates have taken on the moral judgment they decried when it was used against them: Some things are &#8220;right&#8221; and some are &#8220;wrong.&#8221;\u00a0 (In fact, a United Nations committee has even said polygamy <a href=\"http:\/\/www.un.org\/womenwatch\/daw\/cedaw\/recommendations\/recomm.htm\">discriminates against women<\/a>.)\u00a0 At least for now.<\/p>\n<p>The repeal of DADT was largely predicated on the premise that certain things were moot because of the Defense of Marriage Act.\u00a0 When people brought up objections about housing, for example, it wasn&#8217;t even discussed because of DOMA.\u00a0 Now, of course, DOMA is being challenged, and such concerns are shown for the valid objection they always were.<\/p>\n<p>Likewise, appeals for homosexual advocates have often focused on just asking for &#8220;our rights,&#8221; and eschewing the argument about the <a href=\"www2.law.ucla.edu\/volokh\/marriage.pdf\">slippery slope<\/a> of <a href=\"http:\/\/www.walrusmagazine.com\/articles\/2011.05-law-to-the-exclusion-of-all-others\">polygamy<\/a> that some called an &#8220;anti-gay scare tactic.&#8221;\u00a0 The fact they even recognized it could be a &#8220;scare tactic&#8221; lent some legitimacy to the claim itself:\u00a0 While many Americans might support or be indifferent to homosexual unions, most still considered polygamy &#8220;bad.&#8221;<\/p>\n<p>Why the disconnect between morality and logic?\u00a0 Good question.<\/p>\n<p class=\"smallfont\">Via the <a href=\"http:\/\/religionclause.blogspot.com\/2011\/11\/trial-court-upholds-most-of-canadas.html\">Religion Clause<\/a>\u00a0and <a href=\"http:\/\/www.alliancealert.org\/2011\/11\/23\/adf-polygamy-polyamory-fail-at-b-c-supreme-court\/\">the ADF<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>While Canada&#8217;s acceptance of homosexuality was occasionally held up as a contrast to their southern cousins in the United States, it seems Canada hasn&#8217;t worked out all the moral issues associated with &#8220;sexual freedom,&#8221; either.
