{"id":1368,"date":"2009-10-06T00:35:13","date_gmt":"2009-10-06T07:35:13","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=1368"},"modified":"2015-06-27T19:16:31","modified_gmt":"2015-06-27T22:16:31","slug":"weinstein-sues-chaplain-over-prayers","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2009\/10\/06\/weinstein-sues-chaplain-over-prayers\/","title":{"rendered":"Weinstein Sues Chaplain over Prayers"},"content":{"rendered":"<p>According to a <a href=\"http:\/\/www.christianfighterpilot.com\/articles\/files\/klingpraysuit.pdf\">court filing<\/a>, Michael Weinstein, president of the Military Religious Freedom Foundation, and his wife Bonnie are suing Jim Ammerman and Gordon James Klingenschmitt.\u00a0 Ammerman is the head of the <a href=\"http:\/\/www.chaplaincyfullgospel.org\/\">Chaplaincy of Full Gospel Churches<\/a>, which is also named in the suit.\u00a0 The CFGC was one of\u00a0Klingenschmitt&#8217;s\u00a0endorsing agencies.\u00a0 Klingenschmitt is a former US Navy Chaplain who was\u00a0<a href=\"http:\/\/christianfighterpilot.com\/blog\/2008\/04\/18\/navy-chaplain-loses-appeal\/\">court-martialed and discharged<\/a> after he disobeyed orders not to appear in uniform at a protest event.<\/p>\n<p>Weinstein filed the suit due to the allegedly threatening remarks from the defendants.\u00a0 The accusations against Ammerman in the lawsuit are somewhat vague:<\/p>\n<blockquote><p>[Ammerman] made speeches and statements attacking Mikey and his family and containing virulent anti-Semitic comments.\u00a0 He described Mikey as a madman&#8230;and said other hurtful and despicable things.<\/p><\/blockquote>\n<p>Weinstein seems to say that Ammerman&#8217;s comments were offensive, but does not say that they were threatening.\u00a0 In response to Ammerman&#8217;s speeches, Weinstein said he was &#8220;undeterred.&#8221;\u00a0 His main concern was that Klingenschmitt was &#8220;Ammerman&#8217;s&#8230;henchman.&#8221;<\/p>\n<p>Klingenschmitt publicized an\u00a0&#8220;imprecatory prayer&#8221; quoting the Psalms asking God to, among other things, make Weinstein&#8217;s &#8220;days be few:&#8221;<!--more--><\/p>\n<blockquote><p>Let us pray. Almighty God, today we pray imprecatory prayers from Psalm 109 against the enemies of religious liberty, including Barry Lynn and Mikey Weinstein, who issued press releases this week attacking me personally. God, do not remain silent, for wicked men surround us and tell lies about us. We bless them, but they curse us. Therefore find them guilty, not me. <span style=\"text-decoration: underline;\">Let their days be few, and replace them with Godly people. Plunder their fields, and seize their assets. Cut off their descendants<\/span>, and remember their sins, in Jesus&#8217; name. Amen. (<em>emphasis added<\/em>)<\/p><\/blockquote>\n<p>Weinstein asserts that this was a call to violence:<\/p>\n<blockquote><p>Klingenschmitt, on behalf of Ammerman and the CFGC, issued a &#8220;fatwah&#8221; against Mikey&#8230;[calling] upon his followers to commit violence against, or even kill, Michael Weinstein and even his family&#8230;<\/p>\n<p>[Klingenschmitt] is appealing to [his] followers, using Biblical quotes as a code, urging [them] to acts of imminent violence&#8230;Plaintiffs justifiably live in fear of imminent violence against their person and their family.<\/p><\/blockquote>\n<p>Weinstein&#8217;s choice of the phrase &#8220;imminent violence&#8221; is important.\u00a0 The Supreme Court has previously ruled that offensive, and even violent, speech is protected under the Constitution, <em>unless<\/em> there is the spectre of imminent lawless action.\u00a0 See, for example, <em><a href=\"http:\/\/caselaw.lp.findlaw.com\/cgi-bin\/getcase.pl?court=US&amp;vol=395&amp;invol=444\">Brandenburg v Ohio<\/a><\/em> (1969):<\/p>\n<blockquote><p>Freedoms of speech and press do not permit a State to forbid advocacy of the use of force or of law violation except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.<\/p><\/blockquote>\n<p>Perhaps the greatest obstacle Weinstein has to overcome in order to prevail in this lawsuit\u00a0is&#8230;himself.\u00a0 While he hasn&#8217;t engaged in public prayers, he <em><span style=\"text-decoration: underline;\">is<\/span><\/em> guilty of many of his own accusations.\u00a0 Weinstein&#8217;s own<\/p>\n<blockquote><p>conduct [has been] intentional and reckless&#8230;extreme and outrageous<\/p><\/blockquote>\n<p>which is how he describes the defendants&#8217;.\u00a0 His colorful and vitriolic language over the past few years is littered with violence and threats.<\/p>\n<p>Weinstein has said he is &#8220;engaged in&#8230;a bloody battle that only ends with the <a href=\"http:\/\/www.militaryreligiousfreedom.org\/press-releases\/the-anti-crusader.html\">last person standing<\/a>.&#8221;\u00a0\u00a0He has expressed a desire to leave &#8220;<a href=\"http:\/\/www.militaryreligiousfreedom.org\/press-releases\/the-anti-crusader.html\">sucking chest wounds<\/a>&#8221; in those who oppose him.\u00a0\u00a0He &#8220;challenged&#8221; now-disgraced Pastor <a href=\"http:\/\/www.jewishjournal.com\/opinion\/article\/weaponized_evangelism_20070518\/\">Ted Haggard to a fight<\/a> &#8220;behind the junior high school,&#8221;\u00a0expressed a desire to <a href=\"http:\/\/blog.buzzflash.com\/interviews\/065\">box Rush Limbaugh<\/a>, and with respect to Klingenschmitt specifically, <a href=\"http:\/\/www.religionnews.com\/index.php?\/rnstext\/does_god_answer_prayers_to_do_someone_ill1\/\">Weinstein has said<\/a>:<\/p>\n<blockquote><p>I would like to beat the [expletive] out of him in a boxing ring or in an alley behind a Safeway.<\/p><\/blockquote>\n<p>It would seem Weinstein has his own history of making violent threats.<\/p>\n<p>Weinstein must also overcome his own contradictions.\u00a0 In May, Weinstein felt so imminently threatened by these prayers that he chose to further publicize them himself.\u00a0 He\u00a0distributed what he now calls a &#8220;terroristic threat&#8221;\u00a0as\u00a0a fundraising push on his website.\u00a0 Also, just three months ago, Weinstein <a href=\"http:\/\/www.religionnews.com\/index.php?\/rnstext\/does_god_answer_prayers_to_do_someone_ill1\/\">said of these same imprecatory prayers<\/a>:<\/p>\n<blockquote><p>Weinstein has had graffiti sprayed on his house, dead animals left on his doorstep, and bullets shot through his windows. <em>A little prayer, he said, doesn\u2019t bother him. <\/em>(emphasis added)<\/p><\/blockquote>\n<p>(The most recent of the\u00a0acts of\u00a0vandalism cited\u00a0occurred in 2008.)\u00a0 What was once a badge of honor for Weinstein (and a source of fundraising) is now, months later, a source of imminent violence.<\/p>\n<p>Ironically, Weinstein even used &#8220;hurtful and despicable&#8221; speech&#8211;something he decried in the filing&#8211;in the very court filing itself.\u00a0 He misuses the politically-charged and religiously-sensitive Arabic term <em>fatwa<\/em>, despite the fact that his own researcher faced significant criticism when she used the same term to describe Klingenschmitt&#8217;s prayers <a href=\"http:\/\/www.dailykos.com\/story\/2009\/4\/26\/724730\/-Fatwa-Issued-Against-Mikey-Weinstein-and-Barry-Lynn\">earlier this year<\/a>.\u00a0 (In Islam,\u00a0a <em>fatwa<\/em> is a religious opinion, not a &#8220;call to commit violence&#8230;or even\u00a0kill,&#8221; as Weinstein says it is.)\u00a0 It is a prejudicial and insensitive use of a term that advances a negative stereotype of the Islamic faith&#8211;something Weinstein says he fights <em>against<\/em>.<\/p>\n<p>At best, Weinstein&#8217;s lawsuit may be a case of a pot calling the kettle black.\u00a0 At worst, it is another example of Weinstein demanding that others conduct themselves to a standard he himself is unwilling to uphold.<\/p>\n<p>Ultimately, this legal action is little different than any of Weinstein&#8217;s\u00a0previous\u00a0lawsuits.\u00a0 His other lawsuits (this is his fourth in four years) have all included laundry lists of accusations unrelated to the primary complaint.\u00a0 His apparent intent was to use his co-plaintiff as a vehicle to achieve his other objectives.<\/p>\n<p>In this lawsuit, he acknowledges his prior objections to Ammerman and his own campaign to eliminate the CFGC.\u00a0 He has reportedly said he wants to <a href=\"http:\/\/www.jewishjournal.com\/nation\/article\/jewish_lawyers_suit_alleges_chaplain_prayed_for_his_demise_20091006\">&#8220;cripple&#8221; the CFGC<\/a>.\u00a0 He cites no specifics against them, except the unsubstantiated accusation that Klingenschmitt was acting on their behalf.\u00a0 By including them in the lawsuit, however, he may be able to achieve his aim of shutting the CFGC down;
