{"id":11389,"date":"2011-06-07T01:58:59","date_gmt":"2011-06-07T06:58:59","guid":{"rendered":"http:\/\/christianfighterpilot.com\/blog\/?p=11389"},"modified":"2011-06-07T02:00:08","modified_gmt":"2011-06-07T07:00:08","slug":"judge-rules-government-cannot-control-prayer-twice","status":"publish","type":"post","link":"https:\/\/christianfighterpilot.com\/blog\/2011\/06\/07\/judge-rules-government-cannot-control-prayer-twice\/","title":{"rendered":"Judge Rules Government Cannot Control Prayer&#8230;Twice"},"content":{"rendered":"<p>Many have now heard of the Texas High School graduation that received a <a href=\"http:\/\/www.foxnews.com\/us\/2011\/06\/02\/prayer-prohibited-at-graduation-ceremony\/\">court-ordered ban on prayer<\/a>, including the specific words &#8220;amen, invocation,&#8221; and the like.\u00a0 U.S. District Judge Fred Biery had ruled against the Medina Valley Independent School District in a lawsuit brought by the Schultz family.\u00a0 Biery had determined they would &#8220;suffer irreparable harm&#8221; if they heard to a prayer at the ceremony.\u00a0 The ruling was <a href=\"http:\/\/www.foxnews.com\/politics\/2011\/06\/03\/texas-senator-blasts-judges-decision-to-forbid-public-prayer-at-high-school\/#content\">appealed, overturned<\/a>, and the graduation went on as a <a href=\"http:\/\/www.christianpost.com\/news\/texas-graduation-takes-advantage-of-prayer-ruling-goes-all-out-50863\/\">celebration of freedom of speech and religion<\/a>.<\/p>\n<p>That wasn&#8217;t the first controversial ruling on prayer in Texas.<\/p>\n<p>In a ruling that was largely under the radar, Texas Judge Lynn N. Hughes said the Department of Veteran&#8217;s Affairs <a href=\"http:\/\/www.foxnews.com\/us\/2011\/05\/26\/houston-minister-sues-va-memorial-day-prayer\/\">could not control the content of an invited Pastor&#8217;s prayer<\/a>.\u00a0 The Reverend Scott Rainey, pastor at Living Word Church of the Nazerene, had been invited to give an invocation at a Memorial Day event, and was asked to provide <!--more-->an early copy of his prayer.\u00a0 His submission included his closing in &#8220;Jesus&#8217; name,&#8221; as the Pastor has prayed for the prior two years.<\/p>\n<blockquote><p>[Arleen] Ocasio [director of the cemetery] told [Rainey] that if he didn&#8217;t change the prayer, he would not be allowed to deliver the Memorial Day remarks, Rainey said in his lawsuit against Ocasio. But it was a private event, and court papers pointed out that the department only objected to the parts of the speech deemed too religious.<\/p>\n<p>Rainey then pleaded his case to the office of the secretary of Veteran Affairs, but the department told Rainey that the cemetery&#8217;s policy was \u201cviewpoint-neutral\u201d and \u201cappropriate,\u201d according to court papers.<\/p><\/blockquote>\n<p>Rainey apparently sued, and won.<\/p>\n<blockquote><p>Judge Lynn N.
