Magistrate Recommends Dismissal in Transgender Pronoun Case

An Ohio magistrate has recommended that Dr. Nicholas Meriwether’s lawsuit against Shawnee State University (previously discussed) be dismissed. Meriwether had sued when it punished him after he refused to address a biologically male student with a female title — though he did agree to use only a last name.

“Speech by a government employee is protected under the First Amendment only if the speech was made ‘as a citizen’ while addressing ‘a matter of public concern,’” Litkovitz’s recommendation filing reads. “A government employee’s speech is made ‘as a citizen’ and is protected under the First Amendment only when the speech is not ‘pursuant to [the employee’s] duties.’”

That’s an awkward justification, because Meriwether was not punished for making what he claimed was protected speech. Instead, he was being required by the government to have certain content in his speech — content that conveyed a particular ideological view.

The ADF lawyers helping Meriwether said they’ll object on that basis: Read more

Transgender Advocates Celebrate Gallup Poll, Ignore Conflicting Data

The homosexual advocacy American Military Partner Association (AMPA) has merged with OutServe-SLDN to form the Modern Military Association of America. (Apparently, being anything other than heterosexual is “modern.”) The group recently celebrated results from a Gallup poll that appear to show the majority of Americans supporting transgender service in the US military. From their release:

As this survey proves, an overwhelming majority of Americans — including a majority of veterans — agree that what matters is the ability to accomplish the mission, not someone’s gender identity.

While that’s a convenient conclusion, the survey “proves” no such thing.

The survey (available heredoes say that 71% of “national adults” “favor allowing openly transgender men and women to serve in the military?” But look at an important breakdown:

Military veterans: 56% support, 43% oppose
Non-veterans: 73% support, 25% oppose

It would seem people who have actually served in the military are Read more

Air Force Investigating Airman’s Rant Against Homosexuals, Other Religions

The Air Force Times reports an unidentified Airman is under investigation after posting multiple YouTube videos of himself railing against homosexuals and other religions — while in uniform:

[The] airman…denounc[ed] gay people as “sodomites,” “pedophiles,” “roaches” and “vermin scum,” among other slurs.

[He] posted videos on YouTube under the name “Baptist Dave 1611” before taking down his account over the weekend, also voiced support for Grayson Fritts…and his views supporting the execution of gay people…

The videos are no longer available, so the accusations are absent any verifiable context. Assuming the Air Force Times portrayal is correct, the Airman will almost certainly soon be — and certainly should soon be — a civilian.  At least as is reported, his conduct seems unrecoverable.

Not everything the Air Force Times quoted was impermissible on Read more

June was Gay Pride Month. Sort of.

This year the homosexual movement didn’t bother berating President Trump for failing to publish a proclamation about homosexual pride in June. (They did take President Trump to task for his explanation early in June that transgenders require “massive amounts of drugs” and therefore can’t serve in the military — which can be true. As has been noted here before, were any other service member to take the amount of hormones some “transgender” people do, they’d be discharged.)

Even without the announcement, a few military facilities continued to “celebrate” the Stonewall Riots (a violent riot that endangered first responders) as well as their favored sexual practices.

Fort Drum, notably, rewrote that Stonewall history to assert homosexuals were the victims, calling it an “uprising” rather than a “riot” and saying it Read more

Pennsylvania National Guard Discriminated against Trail Life USA

As reported at FoxNews, the Pennsylvania National Guard denied a Trail Life USA group a tour of their facility at Fort Indiantown Gap because of the Christian beliefs of the Trail Life organization:

After researching the organization online, it was quickly discovered that the organization restricted membership to certain persons. Army values and policy prevent discrimination against gender or sexual orientation within our ranks, which in turn led to the first-level reviewer denying the request.

The Army does have that policy, but that’s not how it’s meant to be applied — as is evidenced by how many religiously-related groups with Read more

Supreme Court: Bladensburg Cross Will Stand

A government that roams the land, tearing down monuments with religious symbolism and scrubbing away any reference to the divine will strike many as aggressively hostile to religion. Militantly secular regimes have carried out such projects in the past…
– Justice Samuel Alito

Yesterday the US Supreme Court issued a 7-2 decision that the Bladensburg Peace Cross could continue to stand and be maintained by the state — even though it was “undoubtedly a Christian symbol.” (Of note, the case was reversed and remanded “for further proceedings,” not simply dismissed.)

Some reports focused on the multiple opinions published by the justices, though these reports largely seemed to come from critics who believed that emphasizing the “splintered” nature of the ruling would Read more

US Embassies Can’t Celebrate Gay Pride while US Air Force Flies GayWACS

There’s been much ado about the fact the State Department declined to authorize US embassies to fly “gay pride” rainbow flags from the main embassy flagpoles. (The wailing and gnashing of teeth failed to acknowledge the “ban” only applied to flagpoles, and such flags or other similar decorations were allowed to be flown elsewhere. In fact, one report seemed to think the continued displays were “defiance”, when Vice President Pence explicitly stated no other restrictions were placed on the display of “pride”.) President Obama had begun declaring June “gay pride month,” a “celebration” that has largely fallen silent under President Trump.

US Rep Ilhan Oman even claimed the denial was “bigotry and discrimination” by the Trump administration — strong words, given the traditional treatment of homosexuals by her Islamic faith.

And while the US State Department would not allow “gay pride” to join the US flag around the world, a US Air Force AWACS crew decided they’d advertise on the flight line of in a deployed location: Read more
